A. 
The Mayor, or if he/she so designates, a police committee, is designated and authorized to act as the appropriate authority as defined in and empowered by N.J.S.A. 40A:14-118 et seq.
B. 
The Mayor is designated and authorized to conduct all Police Department disciplinary hearings.
The Mayor, or if he/she so designates, a police committee, as the appropriate authority, may promulgate and adopt such rules and regulations as shall be necessary for the proper and efficient conduct of the Police Department and for the discipline of its members. Such rules promulgated by the appropriate authority shall be adopted by resolution by the Mayor and Council. Such rules and regulations that are in effect at the time of the passage of this section shall continue in effect until further action of the appropriate authority by resolution; provided, however, that nothing herein contained shall be construed to make such rules and regulations part of this article.
In the event of a vacancy in the office of the Chief of Police, the governing body may appoint a Police Director who may or may not be a existing member of the Police Department. The Police Director shall be nominated by the Mayor and appointed by the Council.
The Police Director shall be removed from office as follows:
A. 
The Police Director may be removed from office for cause, defined as:
(1) 
Failure to perform the duties of Police Director as defined herein.
(2) 
Mental and/or physical incompetence to perform the duties of the position of Police Director.
(3) 
Conviction of a felony.
B. 
If the Police Director is notified that he/she is to be removed for cause, he/she may request a public hearing which shall be heard not earlier than 15 days nor later than 30 days after submission of the request to the Mayor. Within five days after the submission of a request for a public hearing, the specification of charges shall be supplied to the Police Director.
The term of office of the Police Director shall be set in the resolution appointing him/her. The salary of the Police Director is to be fixed by the Annual Salary Ordinance of the Borough of North Arlington.
The Director of Police for the Borough of North Arlington shall be charged with the duties of supervising the Police Department in all areas and aspects as it shall impact upon policy and the good order and discipline of the Department, and shall adopt rules and regulations for the Department and establish policies for the daily operation of the Police Department and the discipline of its members.
The Director of Police shall submit monthly reports to the Mayor concerning the operation of the Police Department during the preceding month in such form as shall be prescribed by the Mayor. The Director shall make such other reports as may be requested by the Mayor.
Pursuant to N.J.S.A. 40A:14-118, the Director of Police shall issue any operations orders, general orders, or personnel orders and special orders, standard operating procedures or policies as the Director deems necessary for the efficiency and operation of the Police Department.
Nothing contained herein shall infringe upon or limit the duty and authority of the Chief of Police or Police Director to act to provide for the health, safety, and welfare of the municipality in an emergency through special emergency directives pursuant to N.J.S.A. 40A:14-118 and 40A:14-146.9.
