For the purpose of this article, the following, terms, phrases, words and their derivations shall have the meaning given herein:
ALCOHOLIC BEVERAGE
Any spirits, wine, beer, ale or any other liquid containing more than 1/2 of 1% of alcohol by volume, which is fit for beverage purposes.
BOROUGH
The Borough of North Arlington.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
PLAYGROUND, RECREATION AND PARK AREAS
Those public lands owned, leased to or controlled by or devoted to the general public of the Borough of North Arlington, included but not limited to Wilson Playground, Macaluso Park, Skyline Sports Complex, Jefferson Playground, Washington Playground, Daniel Morris Park, Borough Hall Park, Rip Collins Field, Little League Field, Columbus Park, Price Path, Mary Rusignola Park, Allen Park Playground, Allen Park Field, Portman Park, Cerco Park, Children's Centennial Park, Youth Center, all common ground surrounding North Arlington High School, Queen of Peace High School, as well as any and all schools and day care centers in the Borough.
PUBLIC STREETS AND THOROUGHFARES
Any highway, street, avenue, road, drive, alley, path, driveway and other areas open to and used by the public.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn.

It shall be unlawful for any person to drink or have in their possession any open containers of alcoholic beverage while in or on any playground, recreation and park areas, on a public street or thoroughfare or while in a parked or moving vehicle on any street or public thoroughfare, or on any private property without the permission of the owner in the Borough of North Arlington.
The foregoing prohibitions shall not apply to residents within the Borough of North Arlington requesting permission of the governing body to hold a block party. Before such block party shall take place, the persons involved shall receive clearance from the Police Chief, Fire Department, Department of Public Works and governing body in letter form.
Every person who drinks or has in his/her possession an open container of any alcoholic beverage, as set forth in § 83-28 herein, shall, upon conviction thereof, be punished as provided in Chapter 1, Article I, General Penalty, in the discretion of the court. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
