Borough of North Arlington, NJ Chapter 139 Drug Tolerance Policy

§ 139-1 Applicability.

The Borough of North Arlington zero tolerance policy shall encompass all individuals up to the age of 18 or graduation from high school, whichever shall later occur.

§ 139-2 Banning from municipal and school events.

Any individual who admits use, is convicted, or accepts a diversionary program for any offense relating to the use, possession and distribution of a controlled dangerous substance or alcohol shall forfeit the privilege to participate in any and all municipally sponsored recreational activities and school extracurricular activities for the term as specified below from the date of admission of use, conviction or acceptance to a diversionary program:

A. First offense: three months.

B. Second offense: six months with counseling through the school or an approved alternative at the option of the school.

C. Third offense: 12 months of all activities with mandatory counseling through the school or an approved alternative at the option of the school.

§ 139-3 Supplementary nature of chapter.

The policy contained herein shall be in addition to any preexisting policy in the school system and shall supplement the penal laws of the State of New Jersey.

§ 139-4 Informal hearing.

Prior to the imposition of the forfeiture of the privileges as set forth above, the affected individual, his/her parents or legal guardian may request review of the circumstances at an informal hearing. Said informal hearing shall be conducted by the Borough Recreation Commission, and shall not be subject to the provisions of the Open Public Meeting Act. P.L. 1975 (N.J.S.A. 10:4-6 et seq.).

§ 139-5 Parental pledge and release form.

The parents or legal guardian of any minor participating in a Borough-sponsored activity shall be asked to execute a pledge that the individual shall remain drug- and alcohol-free, execute a release permitting the dissemination of information to the Borough Recreation Department and Board of Education relative to said minor's use, possession and or distribution of a controlled dangerous substance or alcohol, as well as an acknowledgment that the parent or legal guardian has read the Borough's zero drug tolerance policy and agrees to be bound by the terms thereof.
