As used in this article, the following terms
shall have the meanings indicated:
Includes only those containers made entirely of aluminum
and used solely for the packaging of beverages.
Automobile engine oil, machinery engine oil and other oil
utilized in the operation of a motor.
Includes all public or private establishments, including
but not limited to manufacturing, retailing and/or service establishments;
establishments in business for the purpose of consumption, on or off
premises, as well as food distribution and/or processing; and professional
and/or nonprofit or for-profit corporate entities.
Source separated nonputrescible recyclable material generated
from the construction, alteration, repair, maintenance and/or demolition
of structures within Bergen County. This material shall include concrete,
bricks, block, ferrous and nonferrous scrap, asphalt, asphalt shingles,
recyclable wood scrap, and any and all other material generated from
the construction, alteration, repair, maintenance and/or demolition
of a structure or structures within Bergen County that a municipality
may deem recyclable.

Structural material shaped in parallel furrows and ridges
for rigidity, used to make packing and shipping containers.
The following recycling materials which are to be source
separated in the Borough pursuant to P.L. 1987, c. 102, Section 3
(N.J.S.A. 13:1F-99.13): glass beverage containers, aluminum cans,
ferrous scrap, leaves, white goods, tin (ferrous cans), grass, corrugated
cardboard, grade paper, mixed paper and construction and demolition
debris

The transportation, placement, reuse, sale, donation, transfer
or temporary storage for a period not exceeding six months of the
designated recyclable materials for all possible uses except for disposal
as solid waste.
Includes any one-family, two-family or multifamily homes,
apartments and high-rises, condominiums and/or cooperatives.
All metal scrap containing steel and or cast iron

Spoiled fruits or vegetables, stale baked goods, meat trimmings,
plate scrapings and renderings.
Includes all bottles and jars made entirely of glass, devoid
of metal caps and rings, and used in the storage of food and beverages.
Specifically excluded are blue glass and flat glass, commonly known
as "window glass," light bulbs and fixtures.
Green herbage sending up spikelike shoots or blades.

Includes all waste as defined in N.J.S.A. 13:1E-38, N.J.S.A.
13:1E-51 and N.J.A.C. 7:26-8.1 et seq.
White typing and ledger paper, white note pad paper, carbonless
computer printout, manila tab cards and file folders.
Any type of button, coin, cylindrical, rectangular or other
shaped, enclosed device or sealed container consisting of a combination
of two or more voltanic or galvanic cells, electrically connected
to produce electric energy, composed of lead, lithium, manganese,
mercury, mercuric oxide, silver oxide, cadmium, zinc, copper, or other
metals, or any combination thereof, and designed for household use,
including any alkaline, manganese, lithium, mercuric oxide, silver
oxide, zinc-air or zinc-carbon battery, nickel-cadmium rechargeable
battery or sealed lead rechargeable battery

Those materials naturally formed from trees and bushes that
are suitable for composting and mulching purposes.
Source-separated mixture of all types of paper including,
but not limited to, corrugated, high-grade paper, newspaper, magazines,
telephone directories, wrapping paper, box board, books, grocery bags
and junk mail

All residential, commercial and institutional solid waste
generated within the boundaries of the Borough, as measured in tons.
Paper of the type commonly referred to as "newsprint" and
distributed at stated intervals, usually daily or weekly, having printed
thereon news and opinions and containing advertisements and other
matters of public interest.
Any person, firm, partnership, association, corporation,
company or organization of any kind.
All residential, commercial and institutional property in
the Borough of North Arlington.
Includes all municipal and state government facilities; all
religious, educational and health-care facilities; any and all public
and/or private civic organizations; and all nonprofit or for-profit
organizations.
Those items in the definition of "designated recyclable materials"
above, which would otherwise become municipal solid waste and which
are to be collected, separated or processed and returned to the economic
mainstream in the form or raw materials or products.

The process by which designated materials, which could otherwise
become solid waste, are separated, collected, processed and returned
to the economic mainstream in the form of raw materials or products.
Any facility designed and operated solely for receiving,
storing, processing and transferring source-separated recyclable materials

The services provided by persons engaged in the business
of recycling, including the collection, processing, storage, purchase,
sale or disposition or any combination thereof, of recyclable materials.
Recyclable materials as defined in the definition of "designated
recyclable materials" above, which are kept separate and apart from
all other residential, commercial and institutional solid waste by
the generator thereof for the purpose of collection, disposition and
recycling which have been designated to be kept.

Cans made of steel or tin. The most common are tin-plated
steel cans which contain food.

The following types of appliances: freezers, refrigerators,
dishwashers, washing machines, dryers, hot water heaters, stoves and
the like.
There is hereby established a mandatory source
separation of used newspapers, glass food and beverage containers,
aluminum beverage cans and corrugated cardboard, from the solid waste
generated within the Borough of North Arlington for the purpose of
recycling.
All owners, lessees or occupants of dwelling
units, except those physically disabled; and all owners, lessees and
occupants, except those disabled, of business, commercial and/or industrial
establishments; and all owners, lessees and occupants, except those
physically disabled, of private, public and governmental institutions
and facilities shall, in addition to newspapers, separate glass food
and beverage containers, aluminum beverage cans, corrugated cardboard
and other recyclables as defined herein from the solid waste and shall
recycle these materials in the following manner:
A.
Glass food and beverage containers.
(1)
Glass food and beverage containers used for the storage
of food and/or beverages shall be rinsed clean of all residue and
shall have all caps and/or rings removed.
(2)
Glass food and beverage containers shall be placed
in a container or receptacle having a capacity not to exceed five
gallons. No glass shall be deliberately broken for the purpose of
filling any container or receptacle; however, accidentally broken
glass will be accepted.
(3)
Containers or receptacles shall be placed for collection
on the day/days to be established at the designated collection or
pickup site(s), to be determined by the Borough of North Arlington
or its authorized agent, in accordance with all applicable regulations.
B.
Aluminum beverage cans.
(1)
Aluminum beverage cans will be placed in containers
or receptacles having a capacity not to exceed five gallons.
(2)
Containers or receptacles shall be placed for collection
on the day/days to be established at the designated collection or
pickup site(s), to be determined by the Borough of North Arlington
or its authorized agent, in accordance with all applicable regulations.
C.
Corrugated cardboard.
(1)
Corrugated cardboard shall be broken down to handleable
size and tied securely in flat bundles which must not exceed 40 pounds
per bundle.
(2)
The bundles shall be placed for collection on the
day/days to be established at the designated collection of pickup
site(s), to be determined by the Borough of North Arlington or its
authorized agent, in accordance with all applicable regulations.
D.
Used newspapers.
(1)
All newspapers are to be bundled securely to ensure
that they will not be capable of being windblown or distributed on
the public streets. The maximum weight of any bundle shall not exceed
30 pounds (approximately 12 inches high).
(2)
Newspapers shall be placed or caused to be placed
by the owner, lessee or occupant of every property at the curb no
earlier than 6:00 p.m. of each day, which is the day preceding the
day established by the Borough of North Arlington for pickup within
the district in which the property in question is located; the schedule
for all such pickups to be in the form of a calendar setting forth
the dates for specific pickups.
E.
White goods. White goods shall be placed or cause
to be placed by the owner, lessee or occupant of every property at
the curb for collection only after special arrangements for their
pickup by the Borough have first been made in person or by telephone
or the mails with the Department of Public Works Superintendent.
F.
Food waste. Food waste shall be separated and placed
for collection in a manner provided for by the municipality.
G.
High-grade officer paper shall be separated and placed
for collection in a manner provided for by the municipality.
H.
Leaves shall be separated and placed for collection
in a manner provided for by the municipality.
I.
Automotive waste oil may be separated and disposed
of by either private scavenger or disposed of in receptacles provided
at a site designated by the Department of Public Works Superintendent
with prior authorization by the Department of Public Works Superintendent.
J.
Grass.

(1)
Grass clippings shall be placed in biodegradable paper
bags, or small lightweight containers. Plastic bags will not be accepted.
The weight of each bag or container shall not exceed 40 pounds. Grass
clippings shall not be mixed with twigs, leaves or any other material.
(2)
The bags or containers shall be placed or caused to
be placed by the owner, lessee or occupant of every property at the
curb no earlier than 6:00 p.m. of the day, which is the day preceding
the day established by the Borough of North Arlington for pickup within
the district in which the property in question is located; the schedule
for all such pickup to be in the form of a calendar setting forth
the dates for specific pickups.
(3)
Sweeping, raking, blowing or otherwise placing yard
waste that is not containerized at the curb or along the street is
only allowed during the seven days prior to a scheduled and announced
collection, and shall not be placed closer than 10 feet from any storm
drain inlet. Placement of such yard waste at the curb or along the
street at any other time or in any other manner is a violation of
this chapter. If such placement of yard waste occurs, the party responsible
for placement of the yard waste must remove the yard waste from the
street, or said party shall be deemed in violation of this chapter.

(4)
The owner or occupant of any property, or any employee
or contractor of such owner or occupant engage to provide law care
or landscaping services, shall not sweep, rake, blow or otherwise
place yard waste, unless it complies with Subsection G(3).

K.
Tin cans (ferrous containers).

(1)
Tin cans (ferrous containers) used for the storage
of food shall be rinsed clean of all residue.
(2)
Tin cans shall be placed in a container or receptacle
not to exceed five gallons.
(3)
Containers or receptacles shall be placed for collection
on the day/days to be established, at the designated collection or
pickup site(s) to be determined by the Borough of North Arlington,
or its authorized agent, for collection, in accordance with all applicable
regulations.
L.
Ferrous scrap. Ferrous scrap shall be placed or caused
to be placed by the owner, lessee or occupant of every property at
the curb for collection only after arrangement for their pickup by
the Borough have first been made in person or by telephone or the
mails with the Department of Public Works Superintendent.

A.
Beginning April 1, 1995, household batteries must
be separated for disposal as hazard waste. Residents may deposit batteries
in the marked containers at the following four collection sites:
B.
All normal household batteries, including rechargeable,
will be accepted, lead acid batteries and car batteries excluded.
A.
The Mayor and Borough Clerk of the Borough of North
Arlington are hereby authorized and directed to negotiate and to enter
into contracts for the collection of glass food and beverage containers,
aluminum beverage cans, corrugated cardboard and/or such other designated
recyclable materials as may be determined or to place same out to
bid, if required, by the Local Public Contracts Law (N.J.S.A. 40A:11-1
et seq.).
B.
The Borough of North Arlington may utilize its own
personnel to collect said glass food and beverage containers, aluminum
beverage cans, corrugated cardboard and/or such other designated recyclable
materials or contract out the cost of said collection as may be determined
to be in the best interests of the municipality.
A.
Recyclable material as defined herein shall be the
property of the Borough of North Arlington once placed at the designated
collection or pickup site(s) authorized by the municipality or its
designated agent.
B.
It shall be a violation of this article for any person
unauthorized by the municipality or its designated agent to pick up
or cause to be picked up said recyclable materials as defined herein.
Each such collection will be illegal and in violation hereof and shall
constitute a separate and distinct offense, punishable as hereinafter
provided.
Anything herein to the contrary notwithstanding,
any owner, lessee or occupant of a dwelling unit, public or private
institution or commercial or industrial establishment may donate or
sell said recyclable materials, as defined herein, to any person,
partnership or corporation, whether or not operating for profit. However,
said person, partnership or corporation shall not pick up said recyclable
materials at curbside or at any designated collection or pickup site(s)
authorized by the municipality or its designated agent.

Pursuant to N.J.S.A. 40:49-5, the minimum penalty
shall be a fine which in an amount not exceeding $2,500 or a maximum
penalty of a fine not exceeding $10,000.

As used in this article, the following terms
shall have the meanings indicated:
Those materials naturally formed from trees and bushes that
are suitable for composting and/or mulching purposes.
All residential, commercial and institutional property owners
and/or occupants with the Borough.
Includes all solid waste, garbage, leaves, refuse, trash,
etc., usually disposed of under the municipal garbage contract and
normally placed for pickup by residents in the Borough for usual collection
at regular intervals by the contractor.
Upon the adoption of this article and beginning
September 1 through December 31 of 1988 and continuing during that
period each and every year thereafter as promulgated by regular regulations
issued by the Mayor and Council in accordance with the terms hereof,
it shall be mandatory for all persons, except those physically disabled,
who accumulate leaves to separate the same from municipal solid waste
and to place said leaves at curbside for collection in accordance
with this article at a scheduled interval particular to that specific
geographical area of the Borough as prescribed in the aforementioned
regulations to be promulgated.
All persons shall accomplish those obligations
contained in the previous section in strict conformity with the following
regulations:
A.
The use of any and all plastic container bags in conjunction
with actual leaf collection by the residents/commercial establishments
is prohibited.
B.
All leaves must be separated from municipal solid
waste generated within the Borough and, as a consequence, are prohibited
from inclusion in the regular curbside collection of municipal solid
waste.
Strict adherence to all requirements contained
herein or regulations to be promulgated notwithstanding, any person
may choose to compost and/or mulch their particular leaves on site
for their personal horticultural benefit, provided that such activities
are of no adverse consequence to health and safety codes currently
governing or to be promulgated to govern such activity, and that such
alternate means of disposal are accomplished at no cost to the Borough.
This article shall be enforced by the North
Arlington Police Department and the Department of Health, and any
such other employees or departments of the Borough as designated in
writing by the Borough Administrator.

Any person who violates any provision of this article, as well as regulations issued pursuant thereto, shall, upon conviction thereof, be subject to the penalty in Chapter 1, Article I, General Penalty, at the discretion of the Municipal Court, with each violation constituting a distinct and separate offense.
