[Adopted 5-7-1946 by Ord. No. 596 (Ch. 189, Art. III, of the 1984 Code)]
As used in this article, the following terms shall have the meanings indicated:
AUTOCAB
Any automobile or motor car engaged in the business of carrying passengers for hire which is held out, announced or advertised to operate or run or which is operated or run over any of the streets or public highways of the Borough of North Arlington and the State of New Jersey, and which is hired by charter or for a particular contract, or by the day or hour or other fixed period, or to transport passengers to a specified place or places, or which charges a fare or price agreed upon in advance between the operator and the passenger. Nothing contained in this article shall be construed to include taxicabs or buses employed solely in transporting school children or teachers, or autobuses which are subject to the jurisdiction of the Board of Public Utility Commissioners or such public conveyances as are by law subject to state and/or federal regulations exclusively.
PERSON
Any individual, copartnership, association, corporation or joint-stock company, their lessees, trustees or receivers appointed by any court whatsoever.
STREET
Any street, avenue, park, parkway, highway or other public place.
It shall be unlawful for any person to maintain the operation of any autocab within the Borough of North Arlington without first having obtained a license therefor from the Mayor and Council of the Borough of North Arlington, as hereinafter provided.
Any person desiring to obtain a license for the maintenance of an autocab or autocabs shall make separate application, in writing, to the Mayor and Council for the granting of a license for each vehicle. The application shall be made upon blank forms to be furnished by the Borough of North Arlington and shall give such information as may from time to time be deemed by the License Committee of the Borough Council as requisite to determine the fitness of the applicant to conduct the business and the adequacy of the vehicle and equipment to be used. Every applicant for this license must be a citizen of the United States and at least 21 years of age. No application shall be accepted by the Borough Clerk unless the same shall be accompanied by the full amount of the license fee as provided herein. The said license when issued shall in no wise be construed so as to permit an owner or operator to drive or operate an autocab without an autocab driver's license.
A. 
Each applicant for a driver's license shall be at least 18 years of age, a citizen of the United States or resident alien of the United States and the holder of a state driver's license issued by the State of New Jersey. Each applicant shall prove to the satisfaction of the License Committee of the Borough Council that he/she is in good health, with good eyesight, is able to read and write the English language, is of good character and has knowledge of the traffic regulations of the State of New Jersey. The applicant must furnish with his/her application two recent identification photographs of himself, approximately 1 1/2 inches by 1 1/2 inches, and a copy of his/her fingerprints taken by the Police Department of the Borough.

B. 
All applications for autocab drivers' licenses shall be made in writing to the Mayor and Council, shall be made upon blank forms to be furnished by the Borough of North Arlington and shall give, in addition to the information required by this section, such further information as may from time to time be deemed by the License Committee of the Borough Council as requisite to determine the fitness of the applicant to act in the capacity specified. Each application shall be accompanied by the full amount of the license fee, as hereinafter provided.
Any person holding a license to operate a taxicab pursuant to Article II, Taxicabs, of this chapter shall be authorized to operate an autocab without making any further application and without the payment of any additional license fee.
A. 
No owner's license shall be issued until the applicant shall submit the insurance policy or certificate in lieu thereof required by N.J.S.A. 48:16-14, covering the autocab to be licensed, and until the said autocab has been thoroughly and carefully inspected under the direction or supervision of the License Committee of the Borough of North Arlington and found to be in a safe, clean and sanitary condition for the transportation of passengers.
B. 
Each owner's license issued hereunder shall state the make and license number of said vehicle as granted by the State of New Jersey.

C. 
No owner's license shall be transferred from one vehicle to another until the owner shall first obtain written permission from the License Committee of the Borough Council for such transfer and pay to the Borough Clerk a transfer fee of $25. No owner's license shall be transferred from one owner to another except by direct action by the Mayor and Council and the payment to the Borough Clerk of a transfer fee of $25.

D. 
Autocab drivers' licenses shall not be transferable.
E. 
All applications for transfer of owners' licenses shall be made upon forms furnished by the Borough of North Arlington and shall be accompanied by the full amount of the transfer fee.
F. 
All changes of residence on the part of the holder of any license issued under this article shall be reported in writing to the Chair of the License Committee of the Borough Council within three days after said change.
A. 
All licenses issued under this article shall be good and valid from the date of issue until the 31st day of December next after granting the same.
B. 
The fees to be paid for said licenses shall be as follows:
(1) 
For every autocab: $25.
(2) 
For each autocab driver: $25.

Every driver or operator, when in charge of an autocab under this article, shall have in his/her immediate possession a valid autocab's driver's license, which shall be exhibited at any time upon request by any member of the Mayor and Council, any police officer, any duly authorized agent of the said Borough or any passenger. Each autocab shall also carry, in such a position as to be visible to passengers, a card approved by the License Committee containing such information thereon concerning the owner and operator as the License Committee shall deem necessary.
Each autocab owner shall, every six months, cause each autocab licensed pursuant to this article to be examined by a reputable mechanic to be approved by the License Committee of the Borough Council, and thereupon cause to be filed with the Borough Clerk a written report prepared and signed by the mechanic, setting forth a description of the autocab and certifying the date and the nature of his/her examination and inspection and that the vehicle was found to be in a thoroughly safe condition for the transportation of passengers. The cost of said inspection and certification shall be paid by the licensee.
Any member of the Mayor and Council of the Borough of North Arlington, the Chief of Police or any authorized agent of the Borough shall have the right at any and all times to inspect any and all licensed vehicles.
A. 
Any license may be revoked or suspended at any time for cause, and such license when so suspended or revoked shall not be reissued except for good and sufficient reason shown.
B. 
Licenses may be suspended by the Mayor or Chair of the Police Committee, but no license shall be revoked except by action of the Borough Council.

There is hereby reserved to the Mayor and Council the right to make such rules and regulations in relation to the operation of autocabs and the conduct of the operators thereof as it may from time to time determine to be necessary and proper in the best interests of the public. It is further declared that any violation of such rules and regulations, as made by the Mayor and Council of the Borough of North Arlington, shall constitute a violation of this article, punishable as hereinafter provided.

Any person, firm or corporation who shall violate a provision of this article or fail to comply therewith, or who shall violate or fail to comply with any order or regulation made thereunder, shall severally, for each and every such violation and noncompliance, be subject to the penalties provided in Chapter 1, Article I, General Penalty.
