The provisions of this chapter shall be administered and enforced by the Building Inspector, the Zoning Officer and/or the Code Enforcement Officer of the Borough of Oaklyn.
It shall be the duty of the Building Inspector to:
A. 
Ascertain whether the proposed building, alteration or condition complies with the provisions of this chapter.
B. 
Issue such permits only for the construction, alteration, additions or uses which are in accordance with the provisions and requirements of this chapter.
C. 
Keep a record of all applications for permits and a record of all permits issued, with a notation of all special conditions involved.
D. 
File and safely keep copies of all plans submitted.
E. 
Prepare a monthly report for the Mayor and members of Borough Council summarizing for the period since his last previous report all building permits and certificates issued by him and all complaints of violation and the action by him consequently thereon.
F. 
Inspect and examine any building or structure and order in writing the remedying of any condition found to exist in violation of any provisions or requirements of this chapter.

The Building Inspector shall have the right to enter any building or premises during the daytime in the course of his or her duties. The Zoning Officer and the Code Enforcement Officer shall have the right to enter any exterior premises (building, outbuildings, and dwellings excluded) during normal daytime hours in the course of his or her duties.

A permit shall be required prior to the erection, conversion or structural alteration of any building, structure or portion thereof and prior to the use or change in use of any building or land. Applications for a permit shall be made in writing on the form supplied by the Borough of Oaklyn, and the same shall be filled out by the owner, his duly authorized agent or the person and/or contractor performing or responsible for the performance of the work at the site. Said form shall then be filed with the Construction Code Official, together with a plot plan, drawn to scale, showing the actual dimensions, radius and angles of the lot to be built upon, the exact size and the location of the building or buildings in its or their exact relation to the lot and street line. Where the average front yard depth of the existing buildings does not comply with the district regulation, then the existing buildings in the same block front within 200 feet on either side of the side lot lines of the premises of the applicant shall be shown. The application mentioned above shall be in such form as the governing body shall prescribe and shall contain the name and address of the owner of the land, the exact nature of the work to be done, the name of the contractor or builder, the cost of the work and such other pertinent information as said governing body shall by resolution, from time to time, designate. The application shall then be approved and endorsed by the Construction Code Official or his duly designated representative prior to the issuance of a permit. A permit shall be granted or refused within 30 days after the written application has been filed with the Construction Code Official.
A. 
No building or structure hereinafter erected, constructed or structurally altered shall be permitted, by the person, firm or corporation who erected, constructed or structurally altered the same, to be used or changed in any use until a certificate of occupancy shall have been issued by the Building Inspector stating that the building or the proposed use thereof complies with the provisions of this chapter and any other ordinances or statutes of the State of New Jersey. Prior to the issuance of such certificate, the building must also be inspected and approved by the Plumbing Inspector or the Heating Inspector.
B. 
A certificate of occupancy, if required, shall be applied for coincident with the application for a building permit and shall be issued within 10 days after the erection or structural alteration of such building shall been completed in conformity with the provisions of this chapter. In case the Building Inspector shall decline to issue a certificate of occupancy, his reason for doing so shall be stated on one copy of the application and that copy returned to the applicant. A record of all certificates shall be kept on file by the Building Inspector, and copies shall also be furnished to the owner or builder, the Borough Assessor, Borough Tax Collector and Borough Clerk.

Prior to the erection, construction or structural alteration of any building, structure or portion thereof or change in use of any building, lot or parcel of land, application forms in duplicate shall be obtained from the Zoning Officer and filled out by the owner or his authorized agent. Such forms shall be accompanied by a plot plan, prepared by a land surveyor licensed by the State of New Jersey, drawn to scale showing the actual dimensions, radius and location of the building or buildings in its or their exact relation to the lot and front property lines and such other information as may be necessary to determine compliance with, or provide for the enforcement of, this chapter. One application with an accompanying plot plan shall be returned to the owner, approved or rejected by the Zoning Officer. Applications for certain uses are subject to site plan approval as provided for in this chapter.

A. 
Upon application for a building permit to be issued by the Oaklyn Construction Code Official, or upon any proposed change in the use of unused land, or the proposed change in any existing use, the owner or occupier of said property shall notify the Oaklyn Zoning Officer of such application for a building permit, proposed change in the use of unused land and/or the proposed change in any existing use of his/her property, whereupon the Zoning Officer shall perform an initial inspection of the premises to determine if the proposed building permit, proposed change in the use of unused land, or the proposed change in any existing use is in compliance with this chapter, the statutes of New Jersey or any other decision of the Planning Board.
B. 
Upon the completion, erection, location or alteration of any building or portion thereof for which a building permit shall have been issued by the Construction Code Official, but prior to the use or occupancy of such building or alteration of land, the holder of the building permit or the proposed occupant shall notify the Oaklyn Zoning Officer of such completion or proposed change in use, whereupon the Zoning Officer shall perform a final inspection of the premises and, upon ascertaining that the erection, location or alteration referred to in the building permit has been done in conformity with said permit and in compliance with this chapter, the statutes of New Jersey or any other decision of the Planning Board, shall issue a certificate in writing, to be designated a "zoning permit," that said work has been inspected by him and the use approved is in conformity with all zoning requirements of the Borough of Oaklyn.
C. 
No person shall use or occupy any building hereafter erected or located on any lot, or use or occupy any alteration of any building hereinafter made, or use or occupy any land, unless and until a zoning permit shall have been duly issued as required by the chapter. Notwithstanding the foregoing, in the case of a single-family dwelling occupied immediately prior to commencement of any alteration, the occupant shall not be required by this subsection to vacate the premises pending the issuance of a zoning permit.
D. 
The zoning permit required by this section is in addition to and not in lieu of any and all other permits or certificates that are or may be required by law or by any governmental agency or by virtue of this chapter or any other ordinance of the Borough of Oaklyn or otherwise. For each application for a zoning permit hereunder, there shall be a fee of $45, payable to the Borough of Oaklyn, to defray the costs of investigating said applications and issuing said zoning permit.

The Building Inspector shall require the payment of the sum of $25 for each single-family home, $25 for each apartment unit and $25 for each commercial or industrial building and the sum of $1 for each copy thereof on the application for the certificate of occupancy. All such fees shall be paid into the Borough treasury.
A. 
It is recognized that it may be in accordance with the purpose of this chapter to permit temporary activity for a limited period of time, which activities may be prohibited by other provisions of this chapter. Such uses are of such a nature and are so located that at the time of petition they will:
(1) 
In no way exert a detrimental effect upon the use of land and activities normally permitted in the zone.
(2) 
Contribute materially to the welfare of the Borough of Oaklyn, particularly in a state of emergency, under conditions peculiar to the time and place involved.
B. 
The Mayor and the Borough Council may, by resolution after receiving written application from a property owner or lessee, issue a permit for a period of time not to exceed 45 days for a specified property. Such a permit may be extended for a period of time not to exceed 90 days for such specified property. One application per calendar year per specified property may be made under this section for such a permit and its extension, if applicable.
