A.
The Mayor and Council have found that undesirable noise,
inconvenience and disturbance is caused by retail businesses remaining open
late at night.
B.
The Mayor and Council deem it to be in the best interests
of the residents of the Borough of Old Tappan and in furtherance of their
health, safety and welfare, for retail businesses to cease the conduct of
their businesses at a reasonable hour.
As used in this chapter, the following terms shall have the meanings
indicated:
Any business which holds itself out to the general public for the
sale at retail of goods or services.

Every retail business located within the Borough, excluding restaurants,
pharmacies, nighttime recreational centers and businesses regulated by the
New Jersey Division of Alcoholic Beverage Control, shall be closed to the
public, and business with the public therein shall be and is hereby prohibited,
between the hours of 12:00 midnight and 7:00 a.m., except that fitness centers
shall be closed to the public, and business with the public therein shall
be and is hereby prohibited, between the hours of 12:00 midnight and 5:00
a.m.
