A code regulating retail food establishments and fixing penalties is
hereby established pursuant to N.J.S.A. 26:3-69.1 et seq. A copy of the code
is annexed to and made a part of this chapter without the inclusion of the
text herein.
The code established and adopted by this chapter is described and commonly
known as the "Retail Food Establishment Code of New Jersey (1965)."
Three copies of the Retail Food Establishment Code of New Jersey (1965)
have been placed on file in the offices of the Secretary of the Board of Health
and the Borough Clerk for the use and examination of the public.
A.Â
Examination, certificate and filing required. No person
shall hereafter engage, nor shall any person employ or allow a person to work
for him, in the business of handling food intended for distribution or sale
in the borough for human consumption unless such person files with the employer
a medical certificate signed by a physician licensed to practice medicine
in the State of New Jersey showing that the person has been examined under
rules and regulations prescribed by the Board of Health for the purpose of
this code and that the examination failed to show that such person was affected
with an infectious disease in a communicable stage or was harboring the causative
agent of any such disease. A copy of the certificate shall be filed with the
Board of Health.

Employers and owners. In case the employer or owner or
other person in charge of any such business is himself engaged in the handling
of such foods, this person shall file such certificate with the Board of Health.
