A code regulating the manner in which refuse may be stored, collected
and disposed of; declaring and defining certain conditions as nuisances; fixing
the responsibilities and duties of persons storing, collecting or disposing
of refuse; and providing for issuance of permits to collect refuse is hereby
established pursuant to the provisions of N.J.S.A. 26:3-69.1 et seq. A copy
of the code is annexed to and made a part of this chapter without the inclusion
of the text herein.
The code established and adopted by this chapter is described and commonly
known as the "Solid Waste Code of New Jersey (1959)."
Three copies of the Solid Waste Code of New Jersey (1959) have been
placed on file in the offices of the Secretary of the Board of Health and
the Borough Clerk for the use and examination of the public.
A.
Dumping prohibited. No person shall dump, bury or allow
to accumulate any garbage, ashes, rubbish, condemned or spoiled animal or
vegetable substances, swill or any offensive or putrescible material on any
land or premises in the borough, except as may be specifically authorized
from time to time by the borough.
B.
Garbage collection; license required. No
person shall engage in the business of collecting or disposing of or transporting
any such substances or materials without first having obtained a license therefor
from the Board. The application shall state:

Vehicle requirements. All vehicles used in the collecting,
transporting or disposing of such materials or substances shall have a closed,
watertight metal body and shall at all times be maintained and operated in
a clean and sanitary manner. Such vehicles shall be kept closed at all times,
except while actually being filled or emptied.
D.
Responsibilities of owner. The owner, tenant, lessee
and occupant of every house, store or other building, or of any part thereof,
or of any other premises in the borough, shall be obligated to place, or cause
to be placed, in a metal watertight box or boxes, barrel or barrels, or other
receptacles, which shall have a tight cover and be kept tightly closed at
all times, all coal or wood ashes, plaster and all other household refuse
and decaying vegetable and animal substances upon his or their premises. All
such receptacles shall be kept in a place accessible for emptying by licensed
collectors and shall be maintained in a sanitary condition.
E.
Inspection of vehicles. All vehicles and receptacles
mentioned in this section shall be available for inspection by the Health
Officer at all reasonable hours.
