GENERAL REFERENCES
Salaries and compensation — See Ch. 60.
The office of Borough Administrator in and for the Borough of Paulsboro is hereby created pursuant to N.J.S.A. 40A:9-136 et seq.
A. 
The Administrator shall be appointed by the Mayor with the advice and consent of the Council.
B. 
The Administrator shall serve at the discretion of the Mayor and Borough Council, provided that he may be removed at any time by a 2/3 vote. The resolution of removal shall become effective three months after its adoption, unless it is given immediate effect. In that case, the Council shall cause to be paid to the Administrator forthwith any unpaid balance of his salary and his salary for the next three calendar months following adoption of the resolution.
C. 
During the absence or disability of the Administrator, he may appoint an Acting Administrator to perform the duties of the office. In the event, however, that the Administrator is absent or disabled for a period of time in excess of one week, the Mayor, with the consent of the Council, may appoint an Acting Administrator to perform said duties.
D. 
On the removal or resignation of the Administrator, the Mayor, with the advice and consent of the Council, shall appoint an Acting Administrator to serve until an Administrator is appointed.
A. 
The Administrator shall be paid a salary fixed and adopted by the Borough Council in the Annual Salary Ordinance. He shall receive no additional compensation for other positions whose titles he may hold, but shall be reimbursed for all necessary expenses incurred in the performance of his duties.
B. 
Unless otherwise provided, no Acting Administrator shall be paid more than his regular salary while serving in such capacity, but he shall be reimbursed for all necessary expenses incurred in the performance of his office. If the Council, by resolution, increases the compensation of the Acting Administrator during his tenure, such increased compensation shall not exceed the maximum salary provided in the Salary Ordinance for the position of Administrator.
A. 
The Administrator shall be appointed on the basis of his executive and administrative qualifications. Previous responsible, successful experience in local government and possession of a master's degree in public administration, business administration or municipal management shall be preferred.
B. 
The Administrator need not be a resident of the Borough or the state at the time of his appointment, but may thereafter reside outside the Borough only with the approval of Borough Council.
A. 
The Administrator shall be the chief administrative officer of the Borough, responsible to the Mayor and Council for the administration of all Borough affairs, with the following powers and duties. He shall:
(1) 
Direct and supervise the administration of all departments, offices and agencies of the Borough, except as otherwise provided by law.
(2) 
Recommend for appointment, to the Mayor and Borough Council, all department heads and other employees whose manner of appointment is not otherwise specified by law, provided that members of boards and commissions shall be appointed by the Mayor with the advice and consent of the Council.
(3) 
Recommend to the Mayor and Council the suspension or removal of all department heads and all other employees whose manner of appointment is not otherwise specified by law, when said suspension or removal is necessary for the good of the Borough.
(4) 
See that all laws and all acts of the Council subject to enforcement by him, or by officers and employees subject to his direction and supervision, are faithfully executed.
(5) 
Prepare and submit the annual budget and capital program to the Mayor and Council.
(6) 
Submit to the Mayor and Council and make available to the public a complete report on the finances and administrative activities of the Borough as of the end of each fiscal year.
(7) 
Make such other reports as the Mayor and/or Council may require concerning the operation of the Borough government.
(8) 
Keep the Mayor and Council fully advised as to the current financial condition and future needs of the Borough and make such recommendations to them concerning the affairs of the Borough as he deems advisable.
(9) 
Perform such other duties as may be required by the Mayor and Council.
B. 
Except for the purpose of inquiry, or in the event of an emergency, the Mayor and the Council and its members shall deal with the administrative staff solely through the Administrator. Neither the Mayor, nor the Council or any member thereof, shall give orders to any Borough employee other than those they appoint, except through the Administrator.
A. 
All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.
B. 
Any provision of this ordinance which is for any reason held invalid or unconstitutional shall be deemed a separate, distinct and independent provision, and the invalidity thereof shall not affect the validity of the remaining portions hereof.
C. 
This ordinance shall become effective immediately upon final passage and publication according to law.
