It shall be unlawful for any person to distribute, cast or cause to
be distributed, cast or placed, in or along any of the streets or public places
of the Borough of Paulsboro or on any of the sidewalks or footpaths thereof,
or into any vestibule, doorway or yard or upon any porch or any other outside
part or appurtenances of any store, dwelling or other building, or in any
automobile, truck or other vehicle, in this Borough, any circulars, advertisements,
handbills, newspapers or other printed matter, without having first obtained
a license from the Borough Clerk so to do.
The Borough Clerk is hereby authorized to issue any such licenses upon
the payment by the applicant of the following fees: One distribution, $10
; more than one and not exceeding 10 distributions, $50; more than 10 but
not exceeding 300 distributions, $150 per annum.
It shall be unlawful for any person, whether such person be the holder
of a license issued hereunder or not, to distribute, cast, place or cause
to be distributed, cast or placed, in or along any of the streets or public
places of the Borough of Paulsboro or any of the sidewalks or footways thereof,
or into any vestibule or yard or upon any porch of any store, dwelling or
other building, or in any automobile, truck or other vehicle within the limits
of said Borough, any wrapping papers, wastepaper, cartons, boxes, fruit skins
or other waste matter of any nature or description.
It shall be unlawful to make any distribution hereunder on Sundays or
legal holidays; provided, however, that this section shall not apply to any
bona fide newspaper published on Sunday.
No person shall permit the distribution or delivery of any printed matter
hereinbefore recited which is indecent, obscene or in any sense immoral.
Every such license shall remain in force and be valid only for the time
and purpose therein expressed, and all annual licenses shall expire at the
end of the calendar year in which they are issued.
The provision of this ordinance shall not be construed to affect or
prohibit the distribution of the United States Mail within the Borough, or
the distribution of newspapers entered as second-class matter with the United
States Post Office.
The word "person," as herein used, shall mean and include natural persons,
copartnerships, corporation and associations.
The purpose of this ordinance is to prevent the careless distribution of the articles enumerated in § 2-1 of this ordinance and to prevent the distribution, casting or placing of other papers and waste matter upon properties so that the same will become obnoxious or unsightly, and to provide the Borough of Paulsboro with a revenue to aid it in connection with operations of the Borough government.
Any person violating any provision of this ordinance shall, upon conviction
thereof, be subject to a fine of not more than $25 for the first offense and
not more than $50 for each subsequent offense, or be imprisoned in the county
jail for not exceeding 30 days.
All ordinances and parts of ordinances inconsistent with any of the
provisions of this ordinance are hereby repealed.
This ordinance shall take effect immediately upon its publication as
required by law.
