A.
Pursuant to N.J.S.A. 47:1A-1 et seq., every citizen
of this state shall have the right to inspect those public records
as defined by law required to be maintained by the Paulsboro Borough
Clerk or by the custodian of any Borough board, authority, commission
or other Borough agency or department. Every citizen of this state
shall also have the right, during such regular business hours and
under the supervision of the Borough Clerk, the custodian or the Clerk's
or custodian's representative, to copy such records by hand and shall
also have the right to purchase copies of such records.
B.
Fees.

(1)
Municipal Court discovery.
(a)
In response to an appropriate request for discovery
in any pending Borough of Paulsboro Municipal Court matter, the court
shall charge $0.75 per page for each of the first 10 pages, $0.50
per page for each of the next 10 pages, and $0.25 per page for each
page thereafter.
(b)
When a requester seeks the production of requested
documents by mail, the court shall charge, in addition to the fees
set forth above, the actual cost of postage plus a one-time stationery
fee of $0.25.
(2)
Police accident reports. The fees for police accident
reports not requested in person at the Borough Administrator Building
and not part of a Municipal Court discovery request shall be $5 for
the first three pages and $1 for each page thereafter.
(3)
Public records generally.
(a)
The fees for documents produced by the Borough
records custodian in response to a request for public records under
the New Jersey Right-to-Know Law, as amended by the Open Public Records
Act, shall be as per N.J.S.A. 47:1A-5b: $0.05 per letter-sized page
or smaller and $0.07 per legal-sized page or larger.

(b)
If the actual cost, excluding labor and other overhead expenses associated with making the copy, of reproducing printed matter for production under this section exceeds the fees set forth in § 55-1B(3)(a), the actual reproduction cost may be charged, not to exceed the following:

A.
Any person may request the Borough Clerk, or any Borough
custodian or person required by law, to transcribe any public meeting,
any public hearing or other public event so recorded, or portion thereof,
upon payment of a transcription fee to cover production of no less
than an original and one copy of each transcript. The original transcript,
and such additional copies ordered, shall be delivered to the person
requesting transcription, one copy to be retained by the Borough or
Borough entity whose public meeting, hearing or event or portion thereof,
was transcribed.
B.
The transcription fee shall be calculated as follows:
for the original transcript, two times the hourly rate of salary paid
to the Borough Clerk, custodian or person so authorized or designated
to make the transcript, and for each copy thereof, $0.50 per page.
A statement of account signed by the maker of the transcript, calculated
in the manner aforesaid, shall be tendered at the time the transcript(s)
is (are) completed and delivered.
C.
Deposits; final payment.
(1)
The Borough Clerk, custodian or person authorized
or designated to make the transcript shall secure from the person
making the transcript request a sum equal to the estimate of cost
for completion. No transcript of any public meeting, hearing or other
Borough event, or portion thereof, shall be commenced unless such
deposit is made.
(2)
Prior to delivery of any completed transcript, or
copies thereof, the Borough Clerk, custodian or person so authorized
or designated to make the transcript shall first collect any balance
of payment due. In the event that the initial deposit exceeds final
transcript costs, the difference thereof shall be refunded to the
party who tendered the deposit.
(3)
There shall be an additional charge of $1 for a Clerk's
or custodian's certificate of certification.
A.
All fees for the copying of public documents or for
the production of any transcripts of any public meeting, hearing or
any public event, or part thereof, shall be paid over to the Clerk
of the Borough of Paulsboro, to be received as general Borough revenues.
B.
Establishing transcript escrow account.
(1)
There shall be established by the Mayor and Borough
Council a bank account to be designated as the "Paulsboro Transcript
Escrow Account," which account shall be utilized for the receipt of
transcript deposits and final payment(s).
(2)
The Borough Clerk shall cause, no less than quarterly,
a statement of account to be made to the Mayor and Council and shall
turn over at that time all such sums for which final transcript payment
has been made. Refund of excess transcript deposit(s) shall be made
from this bank account. No checks shall be drawn on this bank account
unless countersigned by the Borough Clerk and either the Mayor or
Comptroller.
This ordinance shall take effect 20 days after
final adoption and publication according to law.

Certified copy fees for the following documents
are as indicated:
All fees for the above certificates shall be
paid over to and made payable to the "Clerk of the Borough of Paulsboro,"
to be received as general Borough revenues.
The Borough Clerk shall cause, no less than
quarterly, a statement of account to be made to the Mayor and Council
indicating all sums collected for the above certificates.
This ordinance shall take effect immediately
upon final passage and publication as required by law.
