A. 
It shall be unlawful for any person to consume alcoholic beverages within the Borough of Pemberton:
(1) 
While in or on a public street, lane, sidewalk, public parking lot, public or quasi-public place or in any public conveyance.
(2) 
In a private motor vehicle while the same is in motion or parked in or upon any public street, lane or public parking lot.
(3) 
While upon any private property not his own without the express permission of the owner or other person having authority to grant such permission.
B. 
The possession by any person of an opened alcoholic beverage container in any of the places designated in the above Subsection A and which container has less contents therein than a similar unopened container shall be prima facie evidence that the person possessing the container consumed its contents or a part thereof in the places designated in Subsection A above.

It shall be unlawful for any person to discard alcoholic beverage containers within the Borough of Pemberton upon any public street, lane, sidewalk, public parking lot, public or quasi-public place or upon any private property not his own without the express permission of the owner or other person having authority to grant such permission.
Any person who shall violate the provisions of this article shall, upon conviction, be subject to a fine not exceeding $1,250, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof.
