[Adopted 12-16-1974 (Ch. 22, Art. I of the 1975 Code)]
It shall be unlawful for any horses, cattle, dogs, swine, goats, fowl and other animals to travel at large, either upon the public streets or other public places or upon private places (other than upon the private property of the owner of such animals), within the said Borough of Pemberton. For the purpose of this article the term "at large" shall be interpreted to mean an animal, registered or unregistered, muzzled or unmuzzled, traveling unattended by at least one person and under no control by halter, harness, rope, leash or other proper controlling device.

Whenever any animal as indicated in § 56-1 shall be found traveling at large, it shall be the duty of any police officer, or certified animal control officer, to seize or otherwise take into possession such animal and to take or transport such animal to a pound or shelter.

The owner or owners of any animal who shall knowingly or willfully cause, allow, permit or otherwise be responsible for any such animal traveling at large, or who shall fail to use proper or reasonable means to restrain said animal from so traveling from the owner's property, or who shall otherwise violate any of the provisions of this article, shall, upon conviction, be subject to a fine not exceeding $1,250, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof, in the discretion of the Municipal Judge or other officer before whom hearing thereon is held, and such fine may be imposed, collected and enforced in accordance with N.J.S.A. 40:49-5 or the amendments thereof or supplements thereto.
