For the purpose of this article, the terms used herein are defined as follows:
GARBAGE
Any waste material in the process of, or subject to, decomposition or decay incident to ordinary domestic or business use or purpose and shall include, among other things, kitchen refuse, animal or vegetable matter, and/or decaying or decomposing substances resulting from the handling, preparation, cooking or consumption of foods or the handling, storage and sale of produce.
GARDEN REFUSE
Small tree branches less than 12 inches in diameter, hedge, bush and vine trimmings, stalks of vegetables and plants, weeds and similar materials found in residential yards, but shall not mean leaves in bulk, tree trunks or portions thereof or large tree branches.
TRASH
All miscellaneous materials such as rags, leather goods, rubber, broken glass, crockery, and/or similar materials or substances. Trash shall not include items to be recycled, logs, sand, bricks, mortar or other materials used in building operations or which may result from remodeling, and solid waste resulting from industrial processes and manufacturing operations.

It shall be unlawful to place or permit to remain anywhere in the Borough any garbage or other material subject to decay, other than leaves or grass, except in a tightly covered metal or plastic container sufficiently strong for collection purposes.
It shall be unlawful to cause or permit to accumulate anywhere in the Borough any dust, ashes or refuse of such a material that it can be blown away by the wind, except in a covered container.
It shall be unlawful to deposit or permit to fall from any vehicle any garbage, trash or ashes on any public street or alley in the Borough, provided that this section shall not be construed to prohibit placing garbage, trash or ashes in a container complying with the provisions of this article preparatory to having such material collected and disposed of in the manner provided herein.

A. 
Garbage, trash or garden refuse shall be thoroughly drained of all water and placed in a container made of metal or plastic of a substantial nature with a tight-fitting cover so constructed as to prevent spillage or leakage of its contents.
B. 
Garbage, trash or garden refuse must be packed in a container. Where materials cannot be deposited in a container, the same shall be securely and properly tied into bundles or packages to prevent spillage during collection or while located on the sidewalk awaiting collection. The bundles or packages shall be of such size and weight so that they can be handled by one person, and no container, bundle or package shall exceed 50 pounds. No person shall place more than 200 pounds of garbage, trash or garden refuse for collection in any one-week collection period.
C. 
No container shall be placed in front of any street, alley or public place, nor in front of, nor alongside of, the property occupied by another without the consent of such occupant. No container or matter to be collected shall be placed on the curb for collection prior to 3:00 p.m. of the day preceding the nearest collection day. Containers must be removed from the curb by 9:00 a.m. the day following collection and stored so that, except where not possible, they are behind the front plane of the building or structure.
D. 
Trash consisting of appliances shall be separately billed to the owner at the rate established by resolution of the Borough Council. Payment shall be made prior to the date of pickup.

Any person(s) violating any of the provisions of Articles I, II, III and IV of this chapter shall, upon conviction thereof, be subject to the general penalty provisions in Code § 1-1.
