As used in this chapter, the following terms shall have the meanings
indicated:
Any structure intended for swimming, recreational bathing or wading
that contains water over 24 inches (610 mm) deep. This includes in-ground,
aboveground and on-ground pools; hot tubs; spas and fixed-in-place wading
pools.
A.
No private swimming pool as hereafter described shall
be installed or maintained unless:

There shall be erected and maintained a fence having
a minimum height of not less than four feet and a maximum height of not more
than 10 feet. The wall of a dwelling house or accessory building may serve
and be used as an integral part of the fence.
(2)
Such fence shall completely surround the area of the
swimming pool and shall be so constructed as not to have openings, holes or
gaps larger than four inches in any dimension except for doors and gates.
If wire fencing is used, the same shall be no lighter than eleven-gauge wire.
(3)
All doors or gates opening through such enclosures shall
conform to the specifications required above as to height and dimensions of
openings and shall be equipped with a self-closing and self-latching device
for keeping the door or gate securely closed at all times when not in actual
use, except the door of any dwelling which forms a part of the enclosure need
not be so equipped. Gates and doors shall be locked at all times when pool
is not in use.
B.
The Borough Council may make modifications in individual
cases, upon a showing of good cause, with respect to the height, nature or
location of the fence, wall, gates or latches or the necessity therefor, provided
the protection as sought hereunder is not reduced thereby.
Building permit applications shall be made to the Building Inspector
and be accompanied by:
A.
Two complete sets of construction plans for the proposed
pool, drawn accurately to scale, describing in detail the type and location
of fencing to be used, together with location of gates or doors opening through
the enclosure.
A.
All pools shall be equipped with filtering equipment,
and the circulating units of said equipment shall have sufficient capacity
to recirculate the entire contents of the pool within eight hours or less.
B.
The chlorine residuals and pH values shall be maintained
within ranges indicated below:

C.
The Burlington County Board of Health may designate proper
officials to take samples of all pools in the Borough of Pemberton to ensure
compliance herewith.

Whenever any pool is a hazard to the health of the public, the Burlington
County Board of Health or such official constituted to act on behalf of said
Board is authorized to summarily close any such pool upon the failure of the
owner, lessee or occupant of the premises upon which such pool is located
to take satisfactory or reasonably prompt action to abate such hazard to the
health of the public within 24 hours of the receipt of the notice to do so
by said Board of Health or said official, and keep such pool closed until
no further hazard to the public exists.
All persons with existing pools as defined above shall conform to the
provisions of this chapter within 60 days from the date of final enactment
of this chapter.

Any person who shall violate this chapter shall be guilty of an offense and, upon conviction, shall be punishable as provided in Chapter 1, Article I, of the Code of the Borough of Pemberton. Each week's violation shall constitute a separate and additional violation. Notwithstanding the penalty hereinabove provided, the Borough of Pemberton may enforce obedience to this chapter or any part thereof by injunction to restrain such violation.
