[HISTORY: Adopted by the Township Council of the Township of Pemberton 3-16-1995 by Ord. No. 8-1995. Amendments noted where applicable.]
A. 
It is the purpose and intent of this chapter to adopt by reference a certain redevelopment plan prepared by the Township Planning Board, dated February 1995, entitled "Browns Mills Town Center Redevelopment Plan."[1] This chapter is adopted under authority of N.J.S.A. 40A:12A-1 et seq., the Local Redevelopment and Housing Law. This chapter, and the Redevelopment Plan adopted herein by reference, are intended to implement a series of redevelopment strategies to overcome certain obstacles to the comprehensive improvement of the Browns Mills Town Center Zone, in order to improve the quality of life of the entire community of Pemberton Township. The primary thrust of these strategies seek to remove barriers to new investment, business and jobs creation and to deliver a wide range of community retail services within the Town Center redevelopment area. The governing body ultimately hopes to improve not only commercial shopping opportunities for municipal residents, but also housing, employment and recreational opportunities and aesthetic improvements to the Browns Mills Town Center Zone.

By Resolution No. 241-1993, the Pemberton Township Council directed the Township Planning Board to undertake a preliminary investigation to make certain determinations regarding the establishment of a redevelopment area within the meaning of the aforementioned Local Redevelopment and Housing Law. On or about October 19, 1993, in response to said resolution, the Pemberton Township Planning Board issued a report entitled "Preliminary Investigation and Proposed Redevelopment Area: Browns Mills Town Center, Findings and Recommendations." Thereafter, on December 27, 1993, pursuant to all notices required by law, the Pemberton Township Planning Board conducted a public hearing on this matter, following which hearing, the Township Planning Board adopted the aforementioned Preliminary Investigation. On January 27, 1994, the Pemberton Township Council adopted Resolution No. 43-1994 accepting the factual findings set forth in the aforementioned Preliminary Investigation and adopting the geographical boundaries determined therein to define the proposed redevelopment area. The Township Council further directed the Planning Board to conduct additional investigations, discussions and analyses regarding the formulation of a redevelopment plan in accordance with the conditions, criteria and considerations set forth in the Local Redevelopment and Housing Law.
C. 
The Township Planning Board conducted this investigation and analysis and in February 1995 issued a document entitled "Browns Mills Town Center Redevelopment Plan, Second Draft."[2] The Township Council has reviewed said document and is prepared to adopt the same as the redevelopment plan for the Township of Pemberton in accordance with N.J.S.A. 40A:12A-1 et seq.

The Township Council hereby finds and determines that the specifically delineated project area, as shown on the map attached to the Township Planning Board's Browns Mills Town Center Redevelopment Plan, February, 1995, Second Draft,[1] is an area in need of redevelopment in accordance with the criteria set forth in N.J.S.A. 40A:12A-5 and concludes that the Township Planning Board has met its obligation to follow the criteria set forth at N.J.S.A. 40A:12A-5 prior to making said recommendation.

The Township Council hereby adopts by reference, and incorporates the same herein as if set forth at length, the Browns Mills Town Center Redevelopment Plan, Second Draft, dated February 1995.[1] In adopting said plan, the governing body hereby declares and determines that said plan meets the criteria, guidelines and conditions set forth at N.J.S.A. 40A:12A-7; provides realistic opportunities for redevelopment in said area; and is otherwise in conformance with the provisions of the Local Redevelopment and Housing Law, New Jersey Statutes Annotated.

B. 
Adoption of amendments. The Township Council hereby adopts the Redevelopment Plan attached hereto as Exhibit A and incorporated herein. This redevelopment plan constitutes an overlay zoning district within the redevelopment area.

The Township Council, as the governing body of the Township of Pemberton, shall have and be entitled to and is hereby vested with all powers and authority available to it in furtherance of the goals and purposes of said redevelopment plan. The Township Council is specifically empowered with and authorized to undertake all such actions, proceedings and undertakings as set forth at N.J.S.A. 40A:12A-1 et seq., including by way of example and not by way of limitation, those powers set forth at N.J.S.A. 40A:12A-8, 40A:12A-9, 40A:12A-10, 40A:12A-13, 40A:12A-22, 40A:12A-27, 40A:12A-37, 40A:12A-38, 40A:12A-39 et seq.
Pursuant to the authority vested in the governing body by N.J.S.A. 40A:12A-2, there is hereby established and created within the Township of Pemberton a Browns Mills Town Center Redevelopment Advisory Council to assist and advise the governing body in various development matters. Said Council shall be an ad hoc council, whose members shall serve at the pleasure of the governing body and which shall have no power or authority other than to provide advice and input to the governing body regarding redevelopment matters. Said Advisory Council shall consist of nine individuals, to be appointed by the Township Council, in consultation with the Mayor, the composition of which shall reflect community representations. Appointments to said Council shall be for periods not to exceed three years each and may be for lesser terms at the discretion of the governing body.
Pursuant to the requirements of N.J.S.A. 40A:12A-43, the township shall submit an annual report to the Commissioner of the Department of Community Affairs of the State of New Jersey indicating the name, location and size of all projects undertaken in the redevelopment area. In addition, the annual report shall contain such information as the Commissioner shall deem necessary in order to fulfill the reporting requirements of N.J.S.A. 52:27D-3.3.
The Township Council hereby repeals the following ordinances which were adopted and implemented in furtherance of the township's efforts to be designated an Urban Enterprise Zone under the provisions of the New Jersey Urban Enterprise Zones Act, N.J.S.A. 52:27H-60 et seq.: Ordinance No. 18-1994 and Ordinance No. 17-1994. The following resolutions are also hereby repealed and rescinded: Resolution Nos. 208-1994, 209-1994 and 210-1994.
