No person shall own, keep, harbor or have custody of any dog within Pemberton Township without first obtaining a license therefor, to be issued by the Registrar of Dogs upon application by the owner(s) and payment of due fees, and no person shall keep or harbor any dog within the Township except in compliance with the provisions of Part 1 of this chapter. Pursuant to § 94-32 of this Code, the maximum number of licenses which will be issued to any person, which shall be defined to include a family unit, and/or owner for the same residential premises shall be four, except as otherwise permitted by § 94-32.
A. 
Any person who shall own, keep or harbor a dog of licensing age shall in the month of January apply for and procure from the Township Registrar of Dogs a license and official metal registration tag for each dog so owned, kept or harbored, and shall place upon each such dog a collar or harness with the registration tag securely fastened thereto. B. 
The person(s) applying for said license and registration tag shall provide a valid certificate that the dog has been inoculated with an approved rabies vaccine by a duly licensed veterinarian, or by such other veterinarian permitted by law to do the same, or that the dog has been certified exempt as provided by regulations of the New Jersey State Department of Health. A. 
A person(s) applying for a license shall pay an annual fee of $6 for each dog (for a maximum of four dogs per residential premises). Effective January 1, 2009, the annual license fee shall be $9.80. In addition to the foregoing license fee, each person shall pay a New Jersey registration fee of $1; a New Jersey Pilot Clinic Fund fee of $0.20 and a New Jersey pet population control fee of $3 for nonspayed/neutered animals (no fee shall be required for spayed/neutered animals for said fund). Said license, registration tags and renewals therefor shall expire on the last day of January in each year.

B. 
Dogs used as Seeing Eye guides for blind persons or dogs used to assist deaf persons and commonly known a "hearing ear" dogs shall be licensed and registered as other dogs hereinabove provided for, except that the owner or keeper of such dog shall not be required to pay any fee therefor.

C. 
License forms and uniform official metal registration tags designed by the State Department of Health shall be furnished by the municipality and shall be numbered serially and shall bear the year of issuance and the name of the municipality.
D. 
Only one license and registration tag shall be required in any licensing year for any dog owned in New Jersey, and such license and tag shall be accepted by all municipalities as evidence of compliance with this section. (N.J.S.A. 4:19-15.3)

The owner of any newly acquired dog of licensing age or of any dog which attains licensing age or any owner of a dog not previously registered who is a new resident to this municipality, shall make application for license and registration tags for such dog(s) within 30 days after such acquisition or age attainment, or in the case of a new resident, within 30 days of the owner having moved into the Township of Pemberton.
The application shall state the breed, sex, age, color and markings of the dog for which license and registration are sought, and whether it is of a long- or short-haired variety; also, the name, street and/or post office address of the owner(s) and the person who shall keep or harbor such dog(s). The information on said application and the registration number issued for the dog shall be preserved for a period of three years by the Registrar of Dogs. In addition, the Registrar of Dogs shall forward to the State Department of Health each month, on forms furnished by the Registrar's office, an accurate account of registration numbers issued or otherwise disposed of. Registration numbers shall be issued in the order of the applications.

A. 
Any person who shall bring or cause to be brought into Pemberton Township any dog licensed in another state for the current year and bearing a registration tag and shall keep the same or permit the same to be kept within the Township for a period of more than 90 days shall immediately apply for a license and registration tag for each such dog, unless such dog be licensed under a kennel. A license and registration tag will not be issued to an owner when there are already four dogs at the residential premises at which the dog shall reside.
B. 
Any person who shall bring or cause to be brought into this Township any unlicensed dog and shall keep the same or permit the same to be kept within the Township for a period of more than 10 days shall immediately apply for a license and registration tag for each such dog, unless such dog be licensed under a kennel (N.J.S.A. 4:19-15.6). A license registration tag will not be issued to an owner when there are already four dogs at the residential premises at which the dog shall reside.

In the event that the owner or keeper of a dog within the Township of Pemberton fails to make application to the Registrar of Dogs of the Township of Pemberton within 31 days of the first day of each year, or within the time frames set forth in § 94-5 and/or § 94-7, as applicable, then, in addition to the license fees set forth in § 94-4 above, a charge of $2 per month shall be made to the Township Clerk for the dog license for each month during which a license application has not been submitted. For the purposes of this section, a month shall not be prorated, but instead, where an owner or keeper has failed to submit a license application during any part of a month, the late fee of $2 per month shall apply.
No person except an officer in the performance of his duties shall remove a registration tag from the collar of any dog without the consent of the owner, nor shall any person attach a registration tag to a dog for which it was not issued. No license or registration tag shall be transferable. (N.J.S.A. 4:19-15.7)
A. 
Any person who keeps or operates or proposes to establish a kennel, a pet shop, shelter or a pound shall apply to the Registrar of Dogs for a license entitling him to keep or operate such establishment.
B. 
The application shall describe the premises where the establishment is located or is proposed to be located and the purpose or purposes for which it is to be maintained, and shall be accompanied by the written approval of the Burlington County health authorities showing compliance with the local and state rules and regulations governing location of and sanitation at such establishment.
C. 
All licenses issued for a kennel, pet shop, shelter or pound shall state the purpose for which the establishment is maintained, and all such licenses shall expire on the last day of January of each year and be subject to revocation by the municipality on recommendations of the State Department of Health or the local County Health Department for failure to comply with all rules and regulations and after the owner has been afforded a hearing by either the State Department of Health or the County Department of Health.
D. 
All holders of such license shall not be required to secure individual licenses for dogs owned by such licensees and kept at such establishments; such licenses shall not be transferable to another owner or different premises. (N.J.S.A. 4:19-15.8)
The annual license fee for a kennel providing accommodations for 10 or less dogs shall be $10, and for more than 10 dogs, $25. The annual license fee for a pet shop shall be $10. No fee shall be charged for a shelter or pound. (N.J.S.A. 4:19-15.9)
No dog kept in a kennel, pet shop, shelter or pound shall be permitted off such premises except on leash or in a crate or other safe control. (N.J.S.A. 4:19-15.10)

A. 
License fees and other moneys collected or received under the provisions of this Part 1 of this chapter, except registration tag fees, shall be forwarded to the Treasurer of the municipality within 30 days after collection or receipt and shall be placed in a special account separate from any of the other accounts of the municipality and shall be used for the following purposes only: for collecting, keeping and disposing of dogs liable to seizure under Part 1 of this chapter; for local prevention and control of rabies; for providing antirabic treatment under the direction of the County Board of Health for any person known to be or suspected of having been exposed to rabies; and for administering the provisions of Part 1 of this chapter. Any unexpended balance remaining in such special account shall be retained therein until the end of the third fiscal year following and may be used for any other purposes set forth in this section. At the end of the said third fiscal year following, and at the end of each fiscal year thereafter, there shall be transferred from such special account to the general funds of the municipality any amount then in such account which is in excess of the total amount paid into said special account during the last two fiscal years next preceding.
B. 
The registration tag fee for each dog shall be forwarded within 30 days after collection by the Registrar of Dogs to the State Department of Health. (N.J.S.A. 4:19-15.11)
The Registrar of Dogs shall forward to the State Department of Health a list of all kennels, pet shops, shelters and pounds licensed within 30 days after the licenses therefor are issued, which list shall include the name and address of the licensee and the kind of license issued. The Chief of Police of the Township shall annually cause a canvass to be made of all dogs owned, kept or harbored within the Township and shall report, on or before May 1 of each year, to the Registrar of Dogs and the State Department of Health the result thereof, setting forth in separate columns the names and addresses of persons owning, keeping or harboring unlicensed dogs and the number of unlicensed dogs owned, kept or harbored by each of said persons, together with a complete description of each of said unlicensed dogs (N.J.S.A. 4:19-15.15). In addition, the Chief of Police shall record the name and address of any owner found to be in violation of § 94-32, and said owner shall be subject to the penalties set forth in § 94-33.
