The purpose of this chapter is to assist in
developing, promoting and encouraging greater and more successful
business and industrial activity in Pennsauken Township. This overall
objective will best be served by: first, having those businesses and
industries presently located in the Township register the names and
general nature of their activity; secondly, the Township will endeavor
to foster a harmonious relationship between Township officials and
members of Pennsauken's business and industrial community; and thirdly,
the Township will interact with the Business, Industry and Government
Council of Pennsauken and promote an exchange of information between
government and Pennsauken's business and industrial community which
will constructively serve the mutual interests of all.
As used in this chapter, the following terms
shall have the meanings indicated:
Includes all commercial and industrial enterprises located
in Pennsauken Township, whether organized as an individual proprietorship,
partnership, corporation or other legal entity.
The act of applying to the Township, through the office of
the Township Clerk, for the issuance of a business and industry certificate
which shall identify the name of the business or industrial activity,
the general nature of such activity, the average number of employees
of the applicant and the principal place of business of such enterprise.
A form issued by the Mayor and the Township Clerk which includes
a serial number specially designated to the individual applicant receiving
such certificate.
All owners of business and industrial enterprises,
located to any extent in Pennsauken Township, shall be obliged to
register with the office of the Township Clerk by filing an application
for the issuance of a registration certificate.[1]
The Township Clerk shall keep and maintain an
active summary of all applicants receiving registration certificates
under this chapter.
The Township officials shall assist all registrants
with information that they require in an effort to promote greater
harmony and cooperation between the Township and the owners of business
and industrial enterprises. Further, the Township officials will encourage
cooperation among the individual registrants in achieving mutually
constructive goals.
The registration certificate of the individual
business or industrial enterprise shall be publicly displayed at the
principal place of business of the business or industrial organization
of the registrant in Pennsauken Township. Upon request by any official
of Pennsauken Township, such registration certificate must be presented,
and further, such Township official may direct that such certificate
must be placed in a more prominent location, and the owner of said
business or industrial enterprise must comply with such request.

Any person or the principal owner of a corporation
or other legal entity who violates any of the provisions of this chapter
shall be subject to prosecution in the Municipal Court of Pennsauken
Township and, further, shall be subject to one or more of the following:
a fine not exceeding $1,250 or imprisonment in the county jail for
a term not exceeding 90 days, or a period of community service not
exceeding 90 days, in the discretion of the Municipal Court Judge.

Cannabis manufacturers, wholesalers and retailers, as said terms
are defined in Section 3 of P.L. 2021, c. 16 (New Jersey Cannabis
Regulatory, Enforcement Assistance, and Marketplace Modernization
Act)[1] and § 141-4 of this Code shall only be permitted uses in the Township as set forth in Chapter 141, Development Regulations. Cannabis cultivators (Class 1), cannabis distributors (Class 4) and cannabis delivery services (Class 6) (except for the delivery of cannabis items and related supplies by a delivery service) shall be prohibited in all zones in the municipality. A maximum of two Class 5 cannabis retailer license establishments will be permitted within the Township.
