Every traveling circus, similar entertainment or amusement shall, before performing or holding any such circus or similar entertainment in the Township of Pennsauken, pay to the Township Clerk the sum of $500 for every circus that shall be performed or held for a period less than 10 days and the sum of $1,000 for any circus or similar entertainment that shall be performed or held for a period of 10 days or more. No such circus or similar entertainment shall be performed or held unless the above fee has been paid as herein provided and unless a permit countersigned by the Chairperson of the Township Committee shall have been obtained therefor.

A. 
Before any permit as provided by § 128-1 of this chapter shall be issued, the person or corporation holding or having charge of any circus or similar amusement shall deposit with the Township Clerk the sum of $1,000, which sum shall be held by the Township Clerk for the space of 10 days after the concluding performance or holding of any such circus or similar amusement as a fund from which may be withheld or deducted any sum or sums that may be necessary to be expended by the Highway Department for the repair of any street, driveway or highway which may, by the wagons, vehicles, horses, equipment or paraphernalia used in such circus or similar amusement, be injured, torn up or destroyed to the extent of requiring repair or reconstruction.[1]

B. 
The Highway Department shall, during the time that any such circus or similar amusement is being operated or held, and during the 10 days following the conclusion of the holding of said circus or similar amusement, repair and put in condition similar to that existing before injury any street or highway so injured as aforesaid and keep an account of all expenditures necessary and proper to affect the same, and, at the expiration of said 10 days, shall direct the Township Clerk, in writing, to return to the person or corporation having charge of said circus or similar amusement any money held by him or her after deducting therefrom such expenses or costs of repairs or restoration of such streets or highways.

Any person or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be subject to one or more of the following: a fine not exceeding $1,250 or imprisonment in the county jail for a term not exceeding 90 days, or a period of community service not exceeding 90 days, in the discretion of the Municipal Court Judge.
