The Township Committee of the Township of Pennsauken finds that the uncontrolled construction of satellite earth station antennas, commonly known as "satellite dishes," in the Township of Pennsauken would be inimical to the health, safety and general welfare of the citizens of Pennsauken Township. It is the purpose of this article to establish standards for the construction and erection of satellite dishes within the Township of Pennsauken in order to protect against injury to persons who may be attracted to such satellite earth station antennas, particularly children, and to prevent the depreciation of land values that could result from the indiscriminate placement of such antennas.
For purposes of this article, the following designations are defined herein:
SATELLITE ANTENNA
Any apparatus which is designed for the purpose of receiving television, radio, microwave, satellite or similar signals with the exception of traditional and conventional television antennas.
No satellite earth station antenna, including its mount, shall be built, erected or modified unless a construction permit is issued by the Construction Official. Any person (which shall include corporations, partnerships, associations or any other legal entity) applying for such a permit shall furnish to the Construction Official such plans, drawings and specifications as he or she may reasonably require as to the satellite earth station antenna to be constructed, erected or modified and shall pay a fee equal and equivalent to the sum of $6 per $1,000 of the value of the cost of said construction and installation of said satellite antenna commonly known as a "satellite dish."
All satellite earth station antennas shall be deemed accessory buildings, as said term is defined in the development regulations of the Township of Pennsauken, and shall be subject to all regulations set forth in said development regulations (§ 141-72, et seq.) governing the location and height of accessory buildings, notwithstanding the provisions of this article. Any inconsistencies between § 141-72 et seq. and the provisions of this article will be resolved in favor of this article when applying only regulations dealing with satellite earth station antennas.
The satellite earth station commonly known as a "satellite dish" shall be permitted in all zones as a permitted use after the following requirements are met:
A. 
A dish antenna is only permitted as an accessory use on a lot which contains a principal structure.
B. 
A dish antenna is not permitted in the front yard of any structure.
C. 
A dish antenna is permitted on the roof of a structure, provided that the diameter of the dish does not exceed a maximum of 10 feet and is effectively screened with mesh covering covering the parabolic dish.
D. 
No lot may contain more than one dish antenna as heretofore regulated.
E. 
No dish antenna placed anywhere on any lot shall exceed a diameter of 10 feet.
F. 
Notwithstanding the provisions of § 141-110A, no satellite dish shall be erected closer than 20 feet to the front building line.
This article is a zoning regulation. Relief from the terms thereof shall be effected by application for variances from the terms of this article presented to the Board of Adjustment of the Township of Pennsauken by utilizing the same procedures set forth for variance application under the terms of the Township Code of the Township of Pennsauken and Title 40, Chapter 55 of the New Jersey Statutes and the rules and regulations of the Board of Adjustment.
Any person, firm or corporation, or his, her or its agent, servant, representative or employee, violating any of the provisions of this article shall be subject to one or more of the following: a fine not exceeding $1,250 or imprisonment in the county jail for a term not exceeding 90 days, or a period of community service not exceeding 90 days. Each day's continuance of a violation of any of the provisions of this article shall be deemed a separate and distinct offense and shall be punishable accordingly.
