On the effective date of this chapter, newspaper "honor boxes," hereinafter defined as coin-operated distribution receptacles for the purchase of newspapers, advertisements and/or brochures, are hereinafter prohibited from being positioned, placed or allowed to be positioned or placed on either side of Westfield Avenue, within the Township of Pennsauken, from the intersection of 42nd Street and Westfield Avenue to the intersection of Cove Road and Westfield Avenue and 125 feet from the west side of the intersection of Browning Road and Westfield Avenue, and from Browning Road and Westfield Avenue in an easterly direction, up to and including the intersection of Browning Road and Washington Avenue. Accordingly, no person, firm, corporation or entity shall place, position or be allowed to maintain any hereinafter-defined newspaper honor box on either side of Westfield Avenue in the area designated hereinabove.
Honor boxes as hereinabove defined shall be permitted on intersecting side streets at the intersecting designated areas of Westfield Avenue, provided that said honor boxes are positioned no less than 30 feet from the Westfield Avenue and side-street intersection, not withstanding the Browning Road designation as indicated in § 181-1 above. In addition, honor boxes shall be permitted in any other location on any other street throughout the Township of Pennsauken. For purposes of measurement, the thirty-foot distance shall begin from the intersectional curbline to the point where the curb on Westfield Avenue turns into the curbline on the adjoining side street.
All honor boxes in the Township of Pennsauken as permitted by this chapter shall be secured on a level surface such as concrete or a similar surface. No honor boxes permitted by this chapter shall be chained to any telephone pole, street sign, bus-stop sign or any other similar roadway sign or directional sign within the boundaries of Pennsauken.
Any person, firm or corporation who has or have placed honor boxes as of the date of the second reading of this chapter shall have 30 days from the effective date of this chapter to remove the same from the prohibited areas as indicated hereinabove, without being in violation of this chapter.
Any person, firm or corporation who violates any provisions of this chapter shall be subject to one or more of the following: a fine not exceeding $1,250 or imprisonment in the county jail for a term not exceeding 90 days, or a period of community service not exceeding 90 days, in the discretion of the Municipal Court Judge.
