The purpose of this article is to provide regulations to residential, commercial, industrial and other users of the garbage collection and yard waste collection system in Pennsauken Township so that all persons are obliged to place their garbage, trash and yard waste in adequate containers, at suitable locations and at designated times. This article shall also provide penalties upon conviction for violation of any of the provisions set forth herein and is not intended to change or amend the existing provisions of Chapter 269, Article I, of the Pennsauken Township Code, but to enlarge upon and provide additional regulations.
For the purpose of this article, certain words
and phrases are defined as follows:
Except as otherwise provided herein, containers used for
storing of garbage or trash shall be galvanized or plastic cans having
handles and tight-fitting covers or, in the case of residential garbage
or trash only, heavy-duty bags having a thickness of no less than
three mils, securely tied unless bags are placed in suitable container.
All such cans or bags shall have a capacity of from 10 to 32 gallons
and shall weigh no more than 50 pounds when filled.

Includes all forms of solid or semisolid waste materials
discarded by persons in Pennsauken Township and shall include garbage,
offal, rubbish, any decaying or vegetable substance or other refuse,
including any waste or worthless matter.
Includes a person of either sex and shall pertain to any
natural person or association of persons, including but not limited
to a partnership, individual proprietorship or corporation or other
business entities recognized by the law of the State of New Jersey.
Includes any street, avenue, road, boulevard, lane, drive,
or other way, which is an existing state, county, or municipal roadway,
and includes the land between the street lines whether improved or
unimproved, and may comprise pavement, curb, gutter, sidewalk, and
parking areas.

A.Â
All garbage and trash intended for collection shall
be drained of all free liquid and shall be wrapped or sacked and then
placed in containers. Other forms of garbage, not containing any form
of free liquid, such as newspapers, magazines, collapsible cardboard
boxes or other containers must be set out in securely tied bundles,
and not placed in a container, provided that no one bundle shall exceed
50 pounds in weight. Such rubbish may also be placed in a container
with garbage, provided that the combined weight of such trash does
not exceed 50 pounds in weight.

It shall be unlawful for any person to place garbage
for collection that is not drained of liquid or semiliquid substance
and the same shall not be collected whether in an approved container
or not. All garbage and rubbish constituting the trash to be collected
must be stored and maintained in a sanitary condition until picked
up by those agents or employees designated by the Township for such
task.

All persons who own or occupy property shall be responsible
for putting their trash at the curb abutting their property in the
proper containers. This shall be done on the day designated for collection,
but no sooner than 4:00 p.m. on the day preceding the day of collection.
Thereafter, empty containers shall be removed by said persons no later
than 8:00 p.m. on the day of collection.

The sweeping, raking, blowing, or otherwise placing
yard waste that is not containerized within the cartway of the street
is not permitted to be placed within 10 feet from any storm drain
inlet. Placement of yard waste in a manner other than as described
herein is a violation of this article and shall be removed by the
party responsible for placement of the yard waste.

Dumpsters or other refuse containers used for the storing of garbage and trash that are exposed to stormwater (rain or snow) shall be covered at all times; shall not be overflowing or contents spilling out; and shall not be leaking or otherwise discharging liquids, semiliquids, or solids. The owner of the dumpster and the owner of the property associated with its use are jointly responsible for compliance with this regulation. Exempted from this regulation are permitted temporary demolition roll-off containers or dumpsters. Also exempted are individual homeowner trash and recycling containers. Individual homeowner trash and recycling containers are regulated by Subsections A, B, and C above.

The Township of Pennsauken currently has the
discarded garbage and trash collected at the curb of its various and
numerous streets by an independent contractor designated for such
purpose. A garbage pickup schedule is on file with the Clerk of the
Township. Annexed hereto is a true and accurate designation of the
garbage pickup schedule for the trash collection. Schedule A[1] designates the garbage pickup schedule for trash collection
in the Township of Pennsauken. The entire remainder of this section
shall remain in full force and effect, so that new or amended schedules,
dealing with the day of collection, may be made by filing the same
with the Clerk of Pennsauken Township, and such amendatory schedules
shall be substituted in place of Schedule A. Such new or amended schedules
of collection shall be advertised in advance at least 15 days prior
to the change, on at least two occasions, in official newspapers of
the Township; except for changes made necessary by holidays, celebrated
by the contractor or the Township, falling on the day of collection,
and in this event, such temporary holiday change shall be advertised
on one occasion at least seven days prior to the change.

Any person who is issued a violation of any
of the provisions of this article shall be subjected to a fine for
a first offense of $15, plus court cost, which is payable without
court appearance. For the second offense, said person shall be fined
at least $25 but no more than $100, plus court cost. For the third
or additional offense, the person shall be subjected to a fine of
at least $100 but not more than $1,000, plus court cost, in the discretion
of the Municipal Court Judge. Mandatory court appearances are required
on second, third or additional offense.
The provisions of this article shall be enforced
by code enforcement officers of the Township of Pennsauken within
the Construction Code Department and under the direction of the Construction
Official.
