It is the legislative intent of the Township Committee of the Township of Pennsauken that, consistent with the public safety, health and welfare of the community, certain parking areas as existing structures or existing facilities must provide for handicapped parking.

Accordingly, it is therefore ordained by the Township of Pennsauken, County of Camden and State of New Jersey, that any owner or lessee of any aforesaid property which contains any parking yard or other parking facility, in the Township of Pennsauken, with three or more parking spaces must provide handicapped parking spaces as follows:
A. 
Commercial uses.

(1) 
One designated handicapped parking space shall be provided where the commercial use has three to 24 parking spaces.
(2) 
Two designated handicapped parking spaces shall be provided where the commercial use has 24 to 49 parking spaces.
(3) 
Three designated handicapped parking spaces shall be provided where the commercial use has 50 to 99 parking spaces.
(4) 
Large retail stores or commercial businesses that have in excess of 100 parking spaces, a total of 4% of the parking spaces available shall be designated as handicapped parking spaces. Should the four-percent figure equate to less than one full parking space, the number shall be enlarged to the next highest number.
(5) 
The space dimension of the handicapped parking space provided above shall be 12 feet in width by 20 feet in length.
B. 
Industrial uses. All industrial uses shall provide 1% of the total parking spaces available as designated handicapped spaces but under no circumstances less than one per industrial use. Should the one-percent figure equate to less than one full parking space, the number shall be enlarged to the next highest number.
C. 
Institutional uses. All institutional uses such as churches, schools, governmental buildings, etc., shall be mandated to comply with the requirements as set forth in Subsection A, Commercial uses, as stated above.
All such handicapped parking spaces shall be clearly marked with an upright sign, no less than five feet nor more than seven feet from the ground and no smaller than 12 inches by 18 inches in diameter, showing the handicapped symbol, the aforesaid symbol being a wheelchair with blue background with white outlined symbol and green border.

All such locations are hereby designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards or handicapped insignia license plates by the Division of Motor Vehicles pursuant to N.J.S.A. 39:4-205. No person who does not hold such an identification card shall be permitted to park in these handicapped parking spaces and thus will be subject to regulations of § 299-59C of the Township Code of the Township of Pennsauken.
All existing handicapped parking spaces of the Township of Pennsauken, County of Camden, State of New Jersey, shall comply with this article and thus become subject to the regulations herein and the regulations contained throughout Chapter 299 of the Township Code of the Township of Pennsauken.

This article shall be enforced as follows:
A. 
The Code Enforcement Office of the Township of Pennsauken shall be responsible for verifying that the proper amount of designated handicapped spaces have been provided and that the above handicapped spaces are properly marked in accordance with this article.
B. 
The Police Department of the Township of Pennsauken shall enforce the violation and the issuance of summons to individuals who park in designated handicapped parking spaces without the proper vehicle identification card or handicapped insignia license plates issued by the New Jersey Division of Motor Vehicles.
C. 
Any owner of property or lessee of property with three or more parking spaces, who does not provide handicapped parking spaces as hereinbefore described and regulated, on every individual property owned in the Township of Pennsauken as hereinbefore described shall, upon conviction, be punished by a fine of $100 for the first offense and, for subsequent offenses, a fine or not less than $100, and/or up to 90 days community service, on such terms and in such form that the court shall deem appropriate, or any combination thereof.

D. 
Enforcement of § 299-5C shall be by the Police Department, Bureau of Fire Prevention and/or Parking Enforcement Officer, Township of Pennsauken, County of Camden and State of New Jersey.
