Article III: Truck Exclusions; Limited Use Streets

All trucks having a combined registered gross weight of vehicle plus load in excess of four tons and all trucks with a registered gross vehicle weight in excess of four tons shall be excluded from all streets within the Town except from those streets which form a part of the system of truck routes upon which trucks are permitted to travel and operate, as listed in § 67-7B and exemptions listed under § 67-7C.

Exceptions. Per N.J.S.A. 40:67-16.2, nothing in this chapter shall be construed to prevent such trucks from making deliveries of merchandise or other property along streets from which trucks are excluded or to exclude trucks used by public utility companies for construction, installation, operation, or maintenance of public utility facilities in the Town from any street in the Town.

Marking routes. Pursuant to N.J.S.A. 40-67-16.4, The Town of Phillipsburg shall provide for the conspicuous marking of the streets forming the truck routes. The marking shall be by signs so placed and maintained as to clearly show the truck routes by both day and night and shall designate the weight of the trucks which are required to use such truck routes.

Enforcement. The Town of Phillipsburg Police Department, New Jersey State Police or other law enforcement agency as authorized by the State would be responsible for enforcement of these codes.

Penalties for use of restricted roads with grades in excess of 5%. Pursuant to N.J.S.A. 40:67-16.5 and 40:67-16.5a, the Town of Phillipsburg sets the fines as follows which is addition to the overweight fines:

(1)

For a first violation, a fine of not less than $2,500 or more than $3,000; and

(2)

For second or subsequent violations, a fine of not less than $4,000 or more than $5,000.

Penalties for use of restricted roads. The Town of Phillipsburg sets the penalties for trucks with a registered gross weight of over four tons using a road not designated as truck route as follows:

(1)

For a first violation a fine of not less than $2,500 or more than $3,000; and

(2)

For second or subsequent violations a fine of not less than $4,000 or more than $5,000.

Restoration of damages.

(1)

A truck that operates on a roads in the Town of Phillipsburg in violation of this chapter and has a registered gross weight of over four tons will be responsible to pay for all damages that incur to Phillipsburg infrastructure and costs associated with response to damages.

§ 67-7.1 Streets limited for use by bicycles and pedestrians. [1]
