No person shall hereafter temporarily place building materials, stone, sand, lumber, brick or any other objects on the sidewalks or roadways of any of the public streets and alleys of the Town of Phillipsburg without first obtaining permission from the Municipal Engineer.
Any person desiring to obtain a permit shall make application in writing, stating the location in detail where it is desired to place said material and the nature and quantity of material so located.

A. 
Upon approval by the Municipal Engineer of the Town of Phillipsburg, said Engineer shall issue a permit to temporarily place said building material in the street according to such regulations as provided in § 545-7. Said permit shall not be valid until countersigned by the Municipal Clerk and shall be valid for not more than three months from the date of issuance.
B. 
The fee for said permit shall be $15.
All materials and objects temporarily placed in the public streets after a permit duly granted shall not occupy more than 2/5 of the roadway of said public street or alley or more than 1/2 of the sidewalks of said street or alley. Lumber, stone, brick and similar supplies shall be piled neatly and in a safe manner and at such a height as will not interfere with the view of drivers of vehicles at road intersections. Crushed stone, sand and similar material shall be piled neatly so that the roadway shall be free from any particles or parts of materials. All building materials placed in the streets shall be properly marked and protected in the daytime with flags and signals and at night shall be protected by sufficient warning lights to guard against injury to persons lawfully using said roadway or highway.

Each and every person violating any of the provisions of this article shall, upon conviction thereof, be punished as provided in Chapter 1, General Provisions, Article II, General Penalty; and the Judge before whom any such person may be brought may impose such punishment by fine or imprisonment in the county jail as he may see fit, not exceeding the maximum herein fixed.
