No person, with the exception of Borough police, their designees or other law enforcement officers in the discharge of their lawful duties, shall hunt, trap, shoot, snare or in any fashion attempt to kill or capture any bird or wildlife in the Borough.

No person shall take or attempt to take animals of any type, including birds or fowl, by means of a steel or other trap, or set a steel or other trap for any animal, including birds or fowl, in or upon any property within the Borough of River Edge, public or private, without having first obtained the written permission of the owner or occupant of the premises, provided that nothing contained herein shall prohibit the owner or occupant from trapping or setting any such traps on premises owned or occupied by such person.
Nothing contained in this section shall be construed to be in conflict with the State Game Laws of New Jersey.

No person shall, within the limits of the Borough of River Edge, discharge, use or carry a gun or guns, pistol or pistols, revolver or revolvers, firearm or firearms, or BB guns, for the purpose of hunting, shooting, recreation or amusement. The Chief of Police or his designee of the Borough of River Edge, however, shall have the right and authority, in his discretion, to grant a permit or permits to members of gun clubs or shooting clubs within the borough to carry or discharge such gun or guns, pistol or pistols, revolver or revolvers, firearm or firearms, or BB guns, for such purposes, under such conditions and at such times and places as the Chief of Police or his designee may designate. The permit or permits so issued shall be revocable at will by the Chief of Police or his designee.

A. 
Violations of §§ 246-1 and 246-2 shall be punishable as set forth in N.J.S.A. 23:4-16e. For a violation of any other provision of this chapter, the maximum penalty, upon conviction thereof, shall be a fine not exceeding $1,000, or imprisonment for up to 90 days, or a period of community service not exceeding 90 days, or any combination thereof.

B. 
Except as otherwise provided, each and every day in which a violation of any provision of this chapter or any other ordinance of the borough exists shall constitute a separate violation.
C. 
The maximum penalty stated in this section is not intended to state an appropriate penalty for each and every violation. Any lesser penalty, including a nominal penalty or no penalty at all, may be appropriate for a particular case or violation.
