The following rules and regulations are established for the protection, care and control of those public areas and facilities as defined herein, as owned by the Borough of River Edge or leased to the Borough of River Edge to regulate the conduct of persons on or within such areas or using the facilities thereof.

A. 
No person on or within public land owned by the Borough of River Edge shall consume, possess, sell, serve, deliver, distribute, expose for sale or give away any alcoholic beverage without permission of the Borough of River Edge.
B. 
The use of the tennis courts is permitted no earlier than 8:00 a.m. and the use is subject to the rules and regulations established by the Department of Recreation and Cultural Affairs. Use of the courts before 8:00 a.m. and/or any violation of the established rules and regulations will result in the loss of the membership of using the tennis courts as well as the penalties stipulated in § 308-13.
No person on or within public land owned by the Borough of River Edge shall consume, possess, sell, serve, deliver, distribute, expose for sale or give away any alcoholic beverage without permission of the Borough of River Edge.
A. 
No person shall:
(1) 
Drive any motor vehicle or motorized vehicle, including minibikes and snowmobiles, within any public land owned or leased by the Borough of River Edge.
(2) 
Ride a bicycle or fly a model airplane in any area owned or leased by the Borough designated as public land in such a manner as to interfere with another's enjoyment of the facilities of that public area.
(3) 
Engage in any sport or other activities which may endanger another person or persons using public lands.
B. 
No person on such above described property owned or leased by the Borough of River Edge shall:
(1) 
Cut, injure, deface, remove or disturb any tree, shrub, building, fence, bench or other structure, apparatus or property or mark, write upon or post signs upon any building, fence, bench or other structure without the written permission of the Borough of River Edge.
(2) 
Sell, expose for sale or give away goods, wares or circulars; or post, paste, display or fix any sign, notice, placard or advertising device on such land designated as owned or leased by the Borough of River Edge, or upon any fence along the perimeter thereof without the written permission of the Borough of River Edge.
(3) 
Play, engage or take part in any game or competitive sport for money or other valuable thing without the written permission of the Borough of River Edge.
(4) 
Solicit alms or contributions for any purpose without written permission of the Borough of River Edge.
No domestic animals shall be allowed to run at large or to be ridden on in any public lands owned or leased by the Borough of River Edge.
No persons shall drop, place or throw any paper or other refuse except in a receptacle provided for refuse on such land.
No persons shall erect or occupy any tent, stand or other structure in any part of public lands of the Borough of River Edge, or sell, distribute or give away from any such tent, stand or other structure any food, drink or any other item of value without the permission of the Borough of River Edge.
No person shall make or kindle any fire within such public lands owned or leased by the Borough of River Edge, except in picnic stoves or barbecue grills, and only with specific permission of the Borough of River Edge.
No entertainment or exhibition shall be given upon any lands owned or leased by the Borough of River Edge, except upon written permission by the Borough of River Edge. No person shall:
A. 
Utter loud and offensive, profane and indecent language.
B. 
Do any obscene or indecent acts.
C. 
Annoy, obstruct or molest any person.
D. 
Interfere with, encumber, obstruct or render dangerous any drive, path, walks or public places.
E. 
Create a disturbance.

F. 
Climb or stand upon any wall or fence, shelter, seat, statue or other structure not erected for such purpose.
G. 
Bathe, wade or swim in any water, be it freestanding or stagnant, except at such times and in such places it is designated by the Borough of River Edge and with specific permission of the Borough of River Edge.
H. 
Do any act tending or amounting to a breach of the peace.
I. 
Fail to obey an enforcement officer in the proper performance of his or her duty.
No parent, guardian or custodian of any minor shall permit or allow such said minor to do any act prohibited by this chapter.

A person or group seeking issuance of a permit hereunder shall file an application with the Director of Recreation and Cultural Affairs online via Community Pass. All applicants must complete a hold harmless agreement and provide proof of insurance at the time of application. Residents seeking a permit must provide a copy of their homeowner's or renter's insurance policy declaration page. Organizations must provide a certificate of liability insurance naming the Borough of River Edge as an additional insured with limits carried of at least $1,000,000. Fees will be assessed in accordance with the "Recreation Department fees" enumerated in § 206-2JJ and must be paid at the time of application.
This chapter shall be enforced by the River Edge Police Department or other persons designated by the Mayor and Council to diligently enforce the provisions of this chapter.
A. 
A violation of this chapter shall include but not be limited to any person who shall refuse to leave after being ordered to do so by an enforcement officer as set forth by this chapter.
B. 
For a violation of any provision of this chapter, the maximum penalty, upon conviction thereof, shall be a fine not exceeding $1,000, or imprisonment for up to 90 days, or a period of community service not exceeding 90 days, or any combination thereof.

C. 
In addition to any fine or sentence imposed under Subsection B hereof, any person causing damage to any property within the Borough of River Edge shall be held liable for the cost of repair and/or replacement necessitated by such damage.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
PARKS AND RECREATIONAL FACILITIES
All public parks, playgrounds, tennis courts and ball fields publicly owned or leased by the Borough of River Edge upon which the public is invited or upon which the public is permitted and where individuals gather for recreational activities, including all areas adjacent to such facilities, including, but not limited to, any parking area, driveway or drive aisle.
SMOKING
The burning of, inhaling from, exhaling the smoke from, or the possession of a lighted cigarette, cigar, pipe or any other matter or substances which contain tobacco or any other matter that can be smoked, or the inhaling or exhaling of smoke or vapor from an electronic smoking device.
B. 
Prohibition of smoking in public places. Smoking shall be prohibited within the boundaries of Veterans Memorial Park, Brookside Park, Kenneth B. George Park, Cherry Blossom Park and in any other public parks, tennis courts, ball fields and recreational facilities owned or leased by the Borough of River Edge. "No smoking" signs shall be posted in all areas regulated by this section.
C. 
Enforcement. This section shall be enforced by the Police Department and/or the Health Department of the Borough of River Edge.
D. 
Violations and penalties. Any person who violates any provision of this section may be subject, at the discretion of the court, to the following penalties:
(1) 
A fine of not less than $50 but not more than $100 for the first violation.
(2) 
A fine of not less than $100 but not more than $200 for the second violation.
(3) 
A fine of not less than $200 but not more than $500 for the third and subsequent violations.
