[Adopted 12-31-1975 as § 4-7 of the 1975 Code]
As used in this article, the following terms shall have the meanings indicated:
ROADWAY
That portion of any street, avenue or highway lying between the curblines thereof, or, in the event that no curbline is established, comprising the traveled portion thereof.
It shall be the duty of the owner, tenant or person in possession of any lands in the Borough to:
A. 
Keep all brush, hedges, trees or other plant life growing within a radius of 25 feet from the corner of an intersection of any two or more roadways cut to a height of not more than 2 1/2 feet.

B. 
Keep the limbs or foliage on any tree where such limbs or foliage overhang or are over or upon land within a radius of 30 feet from the corner of an intersection of any two or more roadways in the Borough trimmed to provide necessary sight distance.
After an investigation of any complaint of a resident, officer or employee of the Borough relative to a violation of this article, or upon his own motion, the Chief of Police or his duly authorized agent shall notify the owner, tenant or person in possession of the lands complained of, in writing, either personally or by registered or certified mail, to cut the brush, hedges and other plant life as provided in § 362-7A, or to cut the limbs or foliage, within 10 days after receipt of the notice. The official concerned shall reinspect the lands in question after the ten-day period.
If an owner, tenant or person in possession of the lands in question shall fail to abate the condition complained of within 10 days after receipt of notice, the Borough Clerk shall cause the condition complained of to be abated and shall certify the cost to the Council, who shall examine the certificate and, if it is correct, cause the cost as shown thereon to be charged against the lands. The amount so charged shall become a lien upon the lands and shall be added to and become a part of the taxes next to be assessed and levied upon the lands, shall bear interest at the same rate as taxes and shall be collected and enforced by the same officer and in the same manner as taxes. Costs shall be in addition to any penalties imposed for any violation of this article.

For a violation of any provision of this chapter, the maximum penalty, upon conviction thereof, shall be a fine not exceeding $1,000, or imprisonment for up to 90 days, or a period of community service not exceeding 90 days, or any combination thereof.
