The owner or occupant of premises abutting, fronting or bordering on paved sidewalks in the Borough shall remove or cause to be removed all snow and ice from so much of the sidewalks as abut, front on or border the premises within 12 daylight hours after the snow or ice shall have ceased to fall or be formed thereon. In case of ice which may be so frozen to the sidewalks as to make removal impractical, the owner or occupant shall cause the same to be thoroughly covered with sand, salt or ashes within 12 daylight hours after the same shall have ceased to fall or be formed thereon.
No owner or occupant of any premises abutting on any street shall throw, place or deposit any snow or ice onto or upon any street in the Borough except as falls upon or is formed upon that portion of the property so abutting the street lying within the sidewalk lines thereof. All persons shall be prohibited from throwing, casting, placing or depositing snow and ice which is accumulated within the private property belonging to persons or corporations upon the sidewalks or streets of the Borough.
In case snow or ice shall not be removed from the sidewalks or shall be cast, deposited, thrown or placed upon the sidewalk or the street by the owner or occupant of any premises as provided in the section above, the same may be removed by and under the direction of the officer in charge of the Department of Public Works, and the cost thereof, as can be ascertained, shall be certified to the governing body and shall thereupon become and be a first and paramount lien upon the premises and shall be added to, recorded and collected in the same manner as taxes to be assessed and levied upon such premises, shall bear interest at the same rate as taxes and shall be collected and enforced by the same officer and in same manner as taxes, and the imposition and collection of the fine imposed by § 362-38 shall not constitute any bar to the right of the Borough to collect the costs as certified for the removal of the snow or ice in the manner herein authorized.[1]

For a violation of any provision of this chapter, the maximum penalty, upon conviction thereof, shall be a fine not exceeding $1,000, or imprisonment for up to 90 days, or a period of community service not exceeding 90 days, or any combination thereof.
