It is the purpose of this chapter to promote the public health, safety
and welfare of the residents of the Borough of River Edge by prohibiting the
dumping of any leaves, debris, trash, grass clippings, organic, inorganic
or any other matter into the waterways in the Borough of River Edge and providing
for enforcement of said chapter.
The following waterways are regulated by this chapter:
A.
No person, partnership, corporation or any other legal
entity shall dump or permit dumping of leaves, debris, trash, grass clippings,
organic, inorganic or any other matter into the above designated areas where
water flows.
B.
No person, partnership, corporation or any other legal
entity shall construct or permit to be constructed any type of barrier or
device intended to or which in fact does or will change the course of the
flow of water in the areas regulated by this chapter except construction which
is carried out with approval of the appropriate municipal and state authorities.
The Superintendent of the Department of Public Works and his designee
shall be the enforcement officials of this chapter.
For a violation of any provision of this chapter, the maximum penalty,
upon conviction thereof, shall be a fine not exceeding one thousand dollars
($1,000.), or imprisonment for up to ninety (90) days, or a period of community
service not exceeding ninety (90) days, or any combination thereof.
