The controls and restrictions designed to regulate
development within each zoning district are set forth in the attached
Schedule at the end of this chapter and are supplemented by other
sections of this chapter.
Except as hereinafter otherwise provided:
A.
No building or structure shall be erected and no existing
building or structure shall be moved, altered, added to or enlarged,
nor shall any land or building or structure be designed, used or intended
to be used for any purpose or in any manner other than specified among
the uses hereinafter listed as permitted in the zoning district in
which such building, structure or land is situated.
B.
No building or structure shall be erected, reconstructed
or structurally modified to exceed in height the limit hereinafter
designated for the zoning district in which such building or structure
is situated.
C.
No building or structure shall be erected, no existing
building or structure shall be modified, enlarged or rebuilt, nor
shall any open space surrounding any building be encroached upon or
reduced in any manner, except in conformity to the yard, lot area
and building location regulations hereinafter designated for the zoning
district in which such building or open space is situated.
D.
No yard or open space required in connection with
any building or use shall be considered as providing a required open
space for any other building on the same or any other lot, except
as otherwise provided herein.
E.
No minimum off-street parking, loading or unloading
areas shall be considered as providing off-street parking, loading
or unloading for a use, building or structure on any other lot or
parcel than the principal use to which it is ancillary, except as
provided herein.
A.
Any use not specifically designated as a principal
permitted use, an accessory use or a conditional use is specifically
prohibited from all zoning districts in the Borough of River Edge.

B.
The storage and/or sale of goods outside the confines
of a building or structure is prohibited except for the following:
(1)
The sale of automobiles by new automobile sales dealerships.
(2)
The sale of gasoline and related automobile engine fluids at fuel, repair and automotive service facilities. The requirements of § 416-21 shall also apply.

(3)
Accessory sales of newspapers, magazines and flowers
or garden supplies.
(4)
The sale of pine and other trees commonly known as
Christmas Trees, from November 1 to December 31 of each year.
(5)
Garage sales at residential dwellings, subject to
issuance of a special permit by the Borough Clerk.
(6)
Sales of goods by nonprofit and/or philanthropic organizations,
subject to issuance of a special permit by the Borough Clerk.
C.
Sale of retail goods outdoors of a building or structure
may be permitted on a temporary basis upon application to the Mayor
and Council, subject to issuance of a special permit and further subject
to any terms, conditions and fees which may be established by the
governing body on a case-by-case basis.

D.
All classes
of cannabis establishments or cannabis distributors or cannabis delivery
services as said terms are defined in section 3 of P.L. 2021, c. 16,
are prohibited from operating anywhere in the Borough of River Edge,
but not the delivery of cannabis items and related supplies by a delivery
service.
