The owner or owners, tenant or tenants of lands lying within the limits of the Borough of Riverdale shall remove from such lands brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris within 10 days after notice to remove same.
In case such owner or owners, tenant or tenants of lands in said Borough aforesaid shall fail to remove such brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris from said lands as required by the first section of this chapter, it shall be the duty of the Secretary of the Board of Health[1] or other officer of the Borough charged with the duty thereof to remove such brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris from said lands.

In all cases where brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris are removed from any lands as is provided for in this chapter under the direction of an officer of such municipality, such officer shall certify the cost and expense paid and incurred by him to the Council of the Borough of Riverdale, which said Council shall examine said certificate and if found correct shall cause the cost and expense as shown thereon to be charged upon the books of the Borough against said lands; the amount so charged shall forthwith become a lien upon said lands and shall be added to and become and form part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as taxes and collected in the same manner as other taxes.

The owner or owners, tenant or tenants of lands in said Borough who shall fail or neglect to remove such brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris, as required by § 78-1 of this chapter shall, in addition to paying the cost of the removal of said brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris, be liable to a penalty of not more than $1,000 or imprisonment for a term not to exceed 90 days, or both, for each offense. The Judge before whom conviction is had shall fix the amount of said penalty not in excess of the maximum herein provided.
