A. 
Dogs. The shelter shall have these minimum standards:
(1) 
A roof, enclosed sides, a doorway and solid level floor raised at least two inches from the ground.
(2) 
An entryway protected by a self-enclosing door, an offset outer door, or a flexible flap.
(3) 
Bedding, such as cedar shavings, straw or other nonabsorbent material in sufficient quantity for insulation against damp and cold. Bedding shall be kept dry.
(4) 
A minimum of 10 feet by 10 feet of pen space for each dog kept therein which is five months of age or older.
(5) 
Should the property restrictions, environment or mitigating circumstances prevail and the animals must be tethered or tied outdoors, the confinement on the tether shall be no more than eight hours during any twenty-four-hour period. The tether must be at least 15 feet in length and positioned to prevent hanging or tangling. The tethered dog must wear a properly fitted harness or buckle-type collar. The tethered dog must have access to proper shelter as defined in Subsection A(1). No dog shall remain outdoors in temperatures below freezing, 32º F., during the night or for extended periods of time in inclement weather unless the owner of the dog has demonstrated to the Animal Control Officer that, by breed or acclimation, the animal can withstand such circumstances with no harm to the animal.
B. 
Rabbits and other domestic animals normally kept outdoors. Shelters shall be well constructed and appropriate for the species. The animal's physical condition and hair coat shall be considered when determining whether available shelter is proper. The Animal Control Officer in consultation with the Health Department shall be empowered to make such determination. All animals shall have adequate shade and water and shelter from predators.
The following maintenance standards shall be enforced by the Animal Control Officer, in consultation with the Zoning Officer and the Health Department. Failure to abide by them shall result in revocation by the Borough to keep dogs, cats, and other domestic animals.
A. 
Conditions of pens and premises: It shall be unlawful for any person keeping or harboring animals to fail to keep the premises where such animals are located free from excessive animal waste and offensive odors. It shall be unlawful to allow the premises where the animals are kept to become unclean and a threat to the public health by failing to diligently and systematically remove all animal waste from the premises.
A. 
No animal sacrifice shall be performed in the Borough.
B. 
A licensed veterinarian must humanely carry out euthanasia of a sick or injured animal.
C. 
No owner or caregiver shall fail to provide his animals with sufficient, good and wholesome food and water, in suitable containers.
D. 
Proper shelter, protection from weather (wind, precipitation, sun, cold, or other inclement weather conditions), veterinary care, and humane care and treatment shall also be provided.
E. 
No one shall abandon an animal within the Borough.
F. 
No person shall give away any live animal, fish, reptile, or bird as a prize for, or as an inducement to enter any contest, game, or other competition, or induce a sale, or as an inducement to enter into any business agreement whereby the offer was for the purpose of attracting trade.
G. 
No owner or caregiver shall inflict unnecessary cruelty upon a living animal or creature exposing it to prolonged fear, pain, suffering or leave it unattended in a vehicle under inhumane conditions adverse to the health or welfare of the living animal or creature.
H. 
No owner or caregiver shall carry, or cause to be carried, any living animal or creature in or upon a vehicle or otherwise in a cruel or inhumane manner, exposing them to possible injury.
I. 
Appropriate adherence to these standards shall be determined by the Animal Control Officer in consultation with the Health Department. The Animal Control Officer may remove any animal determined to be in immediate danger or to be suffering due to the failure to comply with the standards of this article. The animal will not be retuned to the owner until the Animal Control Officer, in consultation with the Health Department, can determine that compliance has been met. All expenses incurred by this action shall be the responsibility of the animal owner.
J. 
The Animal Control Officer shall have the discretion to allow the animal owner to make corrections to any violations without removing the animal, provided that the animal is not in immediate danger. The Animal Control Officer shall have the authority to determine the date by which such corrections must be made.
Any person found guilty of violating any portion of this article shall, for every such offense, be fined not less than $250 nor more than $1,000 or be imprisoned for a term of not more than six months, or both, in the discretion of the Court. In addition, the Court: 1) shall impose a tern of community service of up to 30 days, and may direct that the term of community service be served in providing assistance to the New Jersey Society for the Prevention of Cruelty to Animals, a district (county) society for the prevention of cruelty to animals, or any other recognized organization concerned with the prevention of cruelty to animals or the humane treatment and care of animals or to a municipal animal control or animal population program; and 2) may require the violator to pay restitution or otherwise reimburse any costs for food, drink, shelter, or veterinary care or treatment or other costs, incurred by any agency, entity, or organization investigating the violation, including, but not limited to, the New Jersey Society for the Prevention of Cruelty to Animals, a district (county) society for the prevention of cruelty to animals, any other recognized organization concerned with the prevention of cruelty to animals or the humane treatment of animals, or a local or state governmental entity.
