The members or personnel of the Police Department shall be a Director of Public Safety, an Acting Director of Public Safety, as occasion may require, a Chief of Police, Sergeant of Police, Lieutenant of Police and such number of regular police officers as shall have been duly appointed and are serving.
The Chief of Police, the Sergeant of Police, Lieutenant of Police and the police officers shall be appointed by the Borough Council of the Borough.
A. 
The initial period of 12 months of the employment of any police officer shall constitute a period of probationary employment, and during such period of 12 months, the Borough Council shall have the right, in its discretion, to terminate the employment of such police officer in accordance with statutory and regulatory provisions concerning same. This probationary period may be extended for up to six additional months upon the recommendation of the Public Safety Committee or the Borough Council.
B. 
There shall be a one-year working probationary period for all employees who are promoted, during which time the promoted employee shall be observed and rated by the Public Safety Committee based on criteria related to the job description for the promotional position. Such criteria shall include, but shall not be limited to, a promoted employee's ability to supervise those employees under his/her direction, the employee's administrative capabilities and the employee's commitment to the promotional position. As early as possible during the probationary period, any promoted employees who are performing unsatisfactorily shall be alerted about their need for improvement, shall be advised as to what specific areas of their performance require improvement and advised if their lack of improvement is of such a degree as to potentially cause their return to their former rank or status. An employee who is returned to his or her former rank or status after this probationary period shall have the ability to request a hearing before the Police Committee contesting that action pursuant to Subsection 4.4.1 of the Police Department Rules and Regulations.[1]

The Chief of Police, the Sergeant of Police, Lieutenant of Police and the regular police officers in the employ of the Borough on the date when Part 1 of this chapter shall take effect shall, on such date, without further action of the Borough Council, become the Chief of Police, the Sergeant of Police, Lieutenant of Police and the police officers, respectively, in the Police Department established by Part 1 of this chapter.
