Editor's Note: Former Art. III, Cats, adopted 11-14-1974 by Ord. No. 313, as amended 12-12-1991 by Ord. No. 8-91, was repealed 3-12-1992 by Ord. No. 2-92. Said ordinance repealed § 45-17, Keeping of more than two cats prohibited, which constituted the only regulatory provisions of this article.
The purpose of this article is to protect the health, safety and welfare of all those frequenting this municipality. Further, it is the purpose of this article to prevent the needless health hazards and nuisances caused by dog feces upon public and private property located within the borough.
No person, agency or institution owning, harboring, keeping or in charge of any dogs shall cause, suffer or allow such dogs to soil, defile, defecate or commit any nuisance upon any public or private property whatsoever, except with the express authority or permission of the owner of said property. The restriction in this section shall not apply to the portion of the street lying between the curbline and the sidewalk, which may be used to curb such dogs under the following conditions:
A. 
Any person, agency or institution which owns a dog within the borough shall not permit such dog to be unattended within the borough and shall require that said dog be restrained by a leash or other appropriate device which, for the purpose of this article, shall be "curbing."
B. 
Any person who so curbs a dog shall immediately remove all feces deposited by such dog by any sanitary method approved by the local Department of Health, and the same shall be deposited in the owner's garbage or in some other sanitary manner approved by the local Department of Health. The deposit shall be properly wrapped, packaged or protected so as to prevent unsightly disposal or smell or interference with the health and welfare of the community of the borough.
No person shall keep, harbor or maintain any dog which habitually barks, whines, howls, or makes other disturbing noises.
Any person who shall violate any of the terms or provisions of this article shall, for the first violation of this article, be subject to a fine of $25 and upon any subsequent violation of this article, be subject to a fine of not less than $50 nor more than $1,000 and/or imprisoned in the county jail for a term not exceeding 30 days as the Judge of the Riverton Borough Municipal Court or such other judge in his discretion shall determine.
