[HISTORY: Adopted by the Mayor and Council

The rules and regulations promulgated herein
shall apply to all public parks, playgrounds and recreational areas.
The Borough Council may, from time to time,
by resolution, adopt such regulations as it may choose to facilitate
the effective operation and control of all parks, playgrounds and
recreation areas under its jurisdiction.
A.Â
It shall be unlawful for any person on Borough property, as contemplated by § 92-1 hereof, to:
(1)Â
Use threatening, abusive or insulting language.
(2)Â
Do any obscene or indecent act.
(3)Â
Throw stones or other missiles.
(4)Â
Play or practice golf.

(5)Â
Interfere with, encumber, obstruct or render dangerous
any public way, path, walk, bridge or public place.
(6)Â
Do any act tending or amounting to a breach of the
peace.
(7)Â
Climb or stand upon any fence, shelter, seat, bridge
railing or support, statue or other erection other than play structures.

(8)Â
Introduce, carry or fire any firecrackers, torpedoes
or fireworks.
(9)Â
Engage in, instigate and/or encourage a contention
or fight.
(10)Â
Assault any person.
(11)Â
Participate in betting, gambling, gaming or use or
operate any slot machine or gaming table or other gambling instrument
or sell fortunes.

Solicit gifts or contributions for any purpose without
permission of the Borough Council.
(13)Â
Possess, use or be under the influence of intoxicating
alcoholic beverages.

(14)Â
Possess, use or be under the influence of drugs as
defined and prohibited by the New Jersey Revised Statutes.
(15)Â
Give entertainment of any kind or transact business
of any kind or hold public meetings or assemblies without permission
of the Borough Council.
(16)Â
Occupy a camp or campground or sleep overnight without
permission of the Borough Council.
(17)Â
Sell, vend or give away any article of merchandise
or other matter or distribute handbills or circulars without permission
of the Borough Council.
(18)Â
Kindle, build, maintain or use a fire except in fireplaces
provided or in an approved container.
(19)Â
Post, paint or affix or erect any sign, advertisement,
banner or any other matter for attracting attention without permission
of the Borough Council.
(20)Â
Possess or use guns, knives, slingshots or other dangerous
weapons.
(21)Â
Possess or use any explosive materials that may cause
an explosion when used either alone or in combination with some other
material to produce rapid flaming combustion or administer a destructive
blow to surrounding objects.
(22)Â
Kill, injure or disturb any animal or bird or damage
any grass, tree, shrub or plant or any building, sign structure or
equipment upon any premises under the jurisdiction of the Borough.

Allow any dog or cat to run at large. In any area
designated by the Borough to operate as a dog park, dogs only will
be permitted off leash in the fenced-in area(s) specified as a dog
run. Otherwise, dogs shall only be permitted at Borough parks and
recreation areas provided that they are restrained by a leash not
exceeding six feet in length and let or controlled by a person capable
of controlling said dog. Dogs shall be prohibited on playground areas
at all times and on athletic playing fields whenever they are in use.

Allow any dog under the ownership or control of such
person to defecate without immediately removing such defecation and
disposing of it in a refuse container or in some other sanitary manner.

Drive or park any motor vehicle, including minibikes, snowmobiles or other power-driven equipment, on Borough property as contemplated by § 92-1 hereof without permission of the Borough Council. Borough maintenance vehicles and those of Borough officials and employees and emergency vehicles shall be permitted.

Swim, wade or otherwise go into any body of water
within the parks, playgrounds and recreational areas of the Borough
of Riverton except in accordance with the rules and regulations relating
to the use thereof. No power-driven boats of any type shall be permitted
on any body of water within the parks, playgrounds and recreational
areas.

Utilize the public parks, playgrounds and recreational
areas other than during daylight hours, with the exception of: previously
approved youth sports organizations may bring in temporary lighting
to be run off a generator during the months of September, October,
November from the hours of 5:00 p.m. to 8:00 p.m. The Borough shall
bear no cost, liability or responsibility of said temporary lighting
fixtures. Individuals entering or using park facilities outside the
lighted area of organized youth sports are in violation of this chapter.

Possess or break glassware, glass bottles or glass
containers.

Roller-skate, skateboard or in-line skate on areas
such as tennis courts, basketball courts and on or about playground
structures.

Erect tents or canopies without first having obtained
the permission of the Borough Council.

No parent, guardian or custodian of any minor
shall knowingly permit or allow said minor to do any act prohibited
by this chapter.

Organizations desiring to use park facilities on a
group basis will make applications, in writing, to the Clerk 30 days
prior to the date desired. Applications shall be available at the
Borough Municipal Building.
B.Â
Organizations utilizing facilities are responsible
for the care of equipment and grounds utilized and the cleaning of
the area at the completion of the event.
C.Â
Organizations utilizing park areas must present proof
of liability insurance covering injuries to participants during the
period the facility is being used, in amounts as determined by the
Borough Council based upon probable risk.
D.Â
Organizations utilizing the park areas will be responsible
for the coordination of traffic control and parking with the Borough
Police Department.
E.Â
The Borough Council shall have the right to refuse
or cancel the use of any facility to organizations or individuals
for reason of repair, construction or other reasons that may be detrimental
to the care and upkeep of the area.
F.Â
The use of baseball fields and fields designated for
soccer use will be by approval of the Borough Park and Recreation
Committee.

G.Â
Organizations utilizing park areas shall be responsible
for any and all damage to the park caused by the organization or its
guests arising out of their event.

H.Â
Organizations utilizing fields designated for soccer use and baseball
fields shall be responsible to pay an annual usage fee as set forth
in the enabling resolution, which is incorporated by reference. Said
fee shall be paid prior to the commencement of any usage by these
organizations on the aforesaid fields.

I.Â
Organizations using the tennis courts for pickleball play must adhere
to the rules and regulations posted at the park and may be responsible
for fees within the fee schedule.

The provisions, prohibitions and requirements
of this chapter shall be enforceable by state and Borough police and
supervisory personnel designated by the Director of Parks and Recreation.
The provisions of this chapter are in addition
to and not in repeal of, except where inconsistent herewith, otherwise
applicable requirements, prohibitions and provisions of law.

Any person who shall violate any provision of
this chapter shall be subject to a fine of not more than $1,000 or
imprisonment for not more than 90 days or a period of community service
not exceeding 90 days or any combination thereof in the discretion
of the Municipal Judge.

Purpose. The designated dog park maintained by the Borough of Riverton
shall be governed by the provisions of this section in the interest
of the health and safety of all residents, visitors, public and the
animals using the Borough's dog park.
B.Â
DESIGNATED DOG PARK
DOG LICENSE
HANDLER
Definitions. As used in this section, the following terms shall have
the meanings indicated:
Fenced-in dog run areas specified by signage within the Borough
of Riverton, including but not limited to the dog park located at
700 Cedar Street.
A current license issued by a governmental authority that
represents that a dog has a valid, unexpired rabies inoculation.
An individual at least 18 years of age who is responsible
for dog(s) while at the dog park. This individual may or may not be
the owner of the dog(s).

Regulations to be adopted and posted for public inspection:
(1)Â
Hours of operation are from 7:00 a.m. to dusk.
(2)Â
Use the dog park at your own risk.
(3)Â
Dogs are the only animals permitted within the dog park. Dogs younger
than four months are not permitted. All dogs must be spayed or neutered.
(4)Â
Dogs must be leashed at all times except within the fenced in area.
(5)Â
No spiked, pronged or choke collars are allowed.
(6)Â
All dogs must wear a valid dog license and be current on vaccinations.
(7)Â
Dog handlers are responsible and liable for the actions and behavior
of their dog at all times. No more than two dogs per handler allowed
at one time.
(8)Â
Handlers must be in control of their dog at all times. Do not leave
your dog unattended.
(9)Â
No aggressive dogs allowed. Dogs must be removed from the park at
the first sign of aggression.
(10)Â
No ill dogs shall be admitted into the dog park.
(11)Â
Handlers are required to clean up after their dog. Waste bags are
to be supplied by dog handlers and disposed of properly in receptacles.
(12)Â
No children under age eight allowed inside the fence. An adult must
accompany all children.
(13)Â
No food of any kind is permitted.
(14)Â
No smoking is allowed.
(15)Â
The Borough, without prior notice, may close the park for maintenance.
(16)Â
All dog bites must be reported to the Riverton Police Department.

Dog handlers who fail to comply with the above rules and regulations
may at the discretion of the Borough be issued a nuisance summons
in accordance with the provisions of N.J.S.A. 2C:33-12.
