There is hereby created the office of Municipal Prosecutor of the Borough of Rutherford.
The Municipal Prosecutor shall be an attorney at law of New Jersey.
The Municipal Prosecutor shall prosecute cases to be tried before the Municipal Court of the Borough of Rutherford alleging a violation of the criminal law of New Jersey, operating a motor vehicle while under the influence of alcohol and such other cases as may be designated by the Mayor and Council upon the recommendation of the Borough Attorney,[1] by statute or by Rule of the Supreme Court of New Jersey.

The term of office of the Municipal Prosecutor shall be for one year, commencing on January 1 and terminating on December 31 of the same year and until a successor shall have been appointed and qualified.
The Mayor shall nominate and, with the advice and consent of the Council, appoint the Municipal Prosecutor, including the filling of a vacancy in said office, which shall be for the unexpired term only.
The salary of the Municipal Prosecutor shall be in such amount as the Mayor and Council shall determine by ordinance.[1]

The duties of the Municipal Prosecutor shall not exceed 80 full workdays in any one year.
An ordinance entitled "An Ordinance Creating the Office of Legal Assistant of the Borough of Rutherford in the County of Bergen and Prescribing the Term, Duties and Salary Thereof," No. 1803, adopted on March 15, 1960, be and it is hereby repealed.
This ordinance shall take effect immediately upon publication according to law.
