This chapter shall pertain to any person, firm or corporation that owns, harbors, keeps and maintains a dog, cat or other animal within the Borough of Rutherford.
Any dog, cat or other animal that bites or attacks a human shall be quarantined for a ten-day period of time at the owner's expense. Confinement shall take place on the animal owner's property or, if off the owner's property, on a leash in the custody of some person or persons capable of controlling such animal or at another site approved by the Rutherford Health Department.
A. 
Any dog, cat or other animal shall not be released from quarantine until the owner of said animal, at the owner's own expense, submits written proof from a licensed veterinarian to the Rutherford Health Department that said animal was examined by a licensed veterinarian and found to be in good health.
B. 
This examination shall take place after the ten-day quarantine period and no later than the 15th day of quarantine, at which time a copy of the veterinarian's report shall be forwarded to the Rutherford Health Department.
Any person, firm or corporation violating any provisions of this chapter shall, upon conviction thereof, in accordance with the provisions of N.J.S.A. 26:3-70, be liable to a penalty of not less than $50 nor more than $500 for each violation. Each day a particular violation continues shall constitute a separate offense.
The provisions of this chapter are declared to be severable, and if any section, subsection, sentence, clause or phrase hereof shall, for any reason, be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this chapter, but they shall remain in effect, it being the legislative intent that this chapter shall stand notwithstanding the invalidity of any part
