All dwellings, houses, stores or other buildings located within the
Borough of Rutherford shall be numbered in conformity with the street numbers
established by the Borough 911 Coordinator and filed in the office of the
Tax Assessor of the borough.
The number so assigned to each building should be displayed by the owner
or occupant on the front of the building or in the front yard of the lot on
which the same stands, in accordance with the specifications set forth herein.
A.
A house or building number shall be:
(1)
In Arabic numerals or letters.
(2)
A minimum height of three inches. If a house or building
is set back more than 50 feet from the curbline the numbers shall have a minimum
height of six inches and be clearly legible from the street.
(3)
Mounted in a secure fashion on the front of the building
so as to be clearly visible from the street.
(4)
Of a contrasting color to the background and arranged
in such a manner so as to be clearly legible from the street, both day and
night.
(5)
At least 36 inches above ground level and so placed that
trees, shrubs and other obstructions do not block the line of sight of the
numbers from the street upon which the building fronts.
B.
Each apartment dwelling unit shall be individually numbered
using a combination of numbers and/or letters and clearly visible from the
hallway leading to the apartment entrance. The use of hyphens in the numbering
combination is prohibited.
C.
If the house or building is set back from the street in a location that the provisions of this chapter cannot be complied with, then the owner, occupant or lessee shall, in addition to displaying the number on the building, provide a post, rod or other type of fixture of a substantial and permanent nature with the number and a directional symbol affixed thereon and so located on the premises that the number and directional symbol shall be conspicuous and visible from the street upon which the building property fronts. Any required sign shall comply with the provisions of Borough Code § 131-18.
D.
If the house or building has lot frontage on more than
one street, then the owner, occupant or lessee shall display the appropriate
sequential number assigned by the 911 Coordinator for said property on the
side of the building where there is lot frontage on a street.
E.
If a building, in addition to its front entrance, has
a rear or side entrance door which is adjacent to and accessible from a street,
driveway, right-of-way or parking lot, then the owner, occupant or lessee
shall also display the appropriate sequential number on the side of the building
where said side or rear door is located.
The owner of any dwelling house, store or other building incorrectly
or improperly numbered shall be notified, in writing, by the Tax Assessor
or such other person so designated by the Mayor and Council to change or replace
such incorrect or improper number within 30 days after date of such notice
for residential properties and 90 days after date of such notice for nonresidential
properties. No enforcement under this chapter shall occur unless and until
proper written notice as required by this section is provided to the property
owner. No continued certificate of occupancy shall be issued until the property
owner brings said property into compliance with the provisions of this chapter.
Upon application by the owner of any property in the borough to the Tax Assessor, the Tax Assessor, acting in conjunction with the 911 Coordinator, shall furnish such owner with the correct number of such property. The property owner shall submit a copy of the front sheet of the property's telephone bill within the time periods established pursuant to § 63A-4 as evidence of compliance with this chapter.
Upon any subdivision of land in the borough resulting in a lot or lots
other than those numbered on the Tax and Assessment Maps, the Tax Assessor
shall, within 30 days after final approval thereof, assign a number to each
lot resulting from said subdivision or resubdivision which shall be in proper
numerical sequence in relation to the numbers assigned to other lots fronting
on the same street; and he shall record the same upon said map and notify
the owner of said property of the numbers so assigned.
Any person or persons, association, firm or corporation violating any
of the terms or provisions of this chapter shall, upon conviction, be liable
to pay a fine of not less than $100 nor more than $500, and the jurisdiction
as to the enforcement of this chapter shall be in the Borough of Rutherford
Municipal Court. The continuation of the offense shall, in each case, constitute
a new offense.
