The Mayor and Council of the Borough of Rutherford, deeming it necessary for the proper and efficient conduct of the affairs of the municipality, and particularly to create a system of recreation programs designed to amuse, entertain and improve the physical fitness and to bring into closer harmony and relationship the community of Rutherford as a whole, the neighborhoods making up that community and the families abiding therein, do, pursuant to the Revised Statutes of the State of New Jersey, hereby establish and create a Recreation Department.
The Recreation Department shall consist of the Superintendent of Recreation, other existing recreational employees and such other assistants and employees as may be determined by the Mayor and Council.
The Mayor and Council, through the Recreation Department, shall have full and complete authority and power to expend moneys raised for and the operation of Harold Wall Field, Tamblyn Field and Memorial Park and all recreation programs thereon.
Said Recreation Department, in conjunction with and under the supervision of the Mayor and Council and the Borough Administrator, shall supervise methods and arrangements for the proper maintenance and care of the lands and improvements of Harold Wall Field, Tamblyn Field, Memorial Park and all structures thereon now or hereafter owned by the borough and all recreational programs; shall formulate rules and regulations for the public use and said areas and all recreational programs; shall submit annually the requested budget indicating what sums may be necessary for the performance of the above functions and duties; and in all respects operate through and under the direction of the Mayor and Council and Borough Administrator in accordance with the administrative procedures and regulations of the Code of the Borough of Rutherford.

The dispute resolution procedures of the Recreation Department are set forth in Appendix A of this Code, copies of which are on file with the Recreation Department and the Borough Clerk. These procedures shall control over any more general procedures applicable to the Recreation Department, and over any inconsistent provisions of the Rutherford Code, to the extent permitted by law.

Effective immediately, all gym monitors shall be subject to the same background check as other Rutherford employees, including the information required on Rutherford employment application forms and any civil/criminal database searches permitted or required by law.
