The owner, tenant or occupant of any lands abutting upon the public highways of the Borough of Rutherford shall remove all snow and ice from the abutting sidewalks of such highways within 12 hours of daylight after the same shall fall or be formed thereon.
In the event that the owner, tenant or occupant of any such real estate shall fail to remove such snow or ice as provided in § 100-1 hereof, the same may be removed by and under the supervision of the Superintendent of Public Works. The cost of removal of any such snow or ice from any sidewalk shall be certified to the governing body of the Borough of Rutherford by the Superintendent of Public Works. The governing body shall examine such certificate and, if found to be correct, shall cause such cost to be charged against the real estate so abutting upon such sidewalk, and the amount so charged shall thereupon become a lien and tax upon such real estate and be added to and be a part of the taxes next to be levied and assessed thereon, and enforced and collected with interest by the same officers and in the same manner as other taxes.
As used in this chapter, the following terms shall have the meanings indicated:
SIDEWALK
Any walk which consists of cement, concrete, bluestone, petroleum hard-top or other covering placed upon the surface of the ground.

No owner, tenant or occupant of nonresidential lands abutting upon the public streets of the Borough of Rutherford shall throw, put, place or cause to be thrown, put or placed into, upon or within any improved right-of-way of any street, road or avenue within the Borough of Rutherford any snow and ice from said nonresidential lands.

A. 
Any person or persons, firm, partnership or corporation violating any of the provisions of this chapter, excepting § 100-4, shall, upon conviction thereof, be subject to a fine of not exceeding $200 and, in default of payment thereof, may be sentenced to imprisonment in the county jail for a term not exceeding 30 days. Each day any such violation is committed or permitted to continue shall constitute a separate offense punishable as such hereunder.
B. 
Any person or persons, firm, partnership or corporation violating the provision of § 100-4 of this chapter shall, upon conviction thereof, be subject to a fine of not less than $250 nor more than $500 for each violation.
An ordinance entitled "An Ordinance to Provide for the Removal of Snow and Ice from the Sidewalks of the Streets and Highways in the Borough of Rutherford," No. 868, adopted on June 21, 1916, be and it is hereby repealed.
This chapter shall take effect immediately upon publication according to law.
