Trees and shrubbery — See Ch. 120.
It shall be unlawful for the owner or occupant of any lands within the
limits of the Borough of Rutherford to permit to exist within the trees or
shrubbery on such premises, tent caterpillars or the nests of tent caterpillars.

The Borough of Rutherford and/or its agents may from time to time make
an inspection of the trees and shrubbery within the Borough of Rutherford
and may remove therefrom tent caterpillars, and, for that purpose, the Borough
of Rutherford and/or its agents shall have the right to enter upon any and
all lands in the Borough of Rutherford. The cost of operations shall be paid
by the property owners.
Any person, persons or corporation who shall permit tent caterpillars
in any trees or shrubbery on his, her, their or its lands or premises or lands
or premises occupied by him, her, them or it, after notification, shall be
subject to and pay a penalty of $25 for each offense. The Judge, however,
before whom conviction is had, may fix the amount of said penalty not in excess
of the maximum provided for herein.
