For the purpose of this article, the following terms shall have the meanings indicated:
PARKING LOT
Any public place or area established by the Borough of Rutherford for the parking of vehicles.

A. 
The establishment of zones, to be known as "parking meter zones," in the following streets and parking lots is hereby authorized:
(1) 
Park Avenue, on both sides, from Erie Avenue to Park Place.

Ames Avenue, on both sides, from Park Avenue to Chestnut Street.

B. 
The Mayor and Council may from time to time suspend or alter the public’s ability to park in metered spaces for any and all parking meter zones established by Borough § 126-24A(1) through (29). In addition, the Mayor and Council may convert any and all parking meter zones to permit parking zones for special events.

From time to time hereafter as traffic conditions require, said zones in such other streets and parking lots may be designated by ordinance.
Upon the installation of parking meters in said parking zones, parking meter spaces shall be designated as hereinafter provided, and the time limitations for legal parking in such zones shall be pursuant to and in compliance with the time limitations fixed by ordinance now in force and effect or hereafter to be adopted.
Authority is hereby given to provide for the installation, regulation, control, operation and use of parking meters and to maintain them in good workable condition. The Mayor and Borough Clerk are hereby authorized to enter into a contract, after the approval of the terms and conditions thereof by the Borough Council, for the purchase and installation of said parking meters. The Mayor and Borough Clerk are further authorized to enter into a contract or contracts, after approval of the terms and conditions thereof by the Borough Council, for such protection and maintenance of said parking meters as may be necessary to maintain the same in good operating condition.
The placement of parking meters shall be as follows:
A. 
Parking meters shall not be installed in areas where parking is prohibited pursuant to the provisions of N.J.S.A. 39:4-138.
B. 
Parking meters installed in the parking meter zones established in § 126-24 hereof shall be placed immediately adjacent to the individual parking spaces hereinafter described. Each parking meter shall be placed or set in such manner as to show or display by a signal that the parking space adjacent to such meter is or is not legally in use. Each parking meter installed shall indicate by a proper legend the legal parking time established or hereafter established by ordinance.
A. 
The Police Department shall have lines or markings placed adjacent to each parking meter for the purpose of designating the parking space for which said meter is to be used, and each vehicle parked adjacent to or next to any parking meter shall park within the lines or markings so established. It shall be unlawful to park any vehicle across any such lines or markings. It shall be unlawful to park in any metered zone, except between any two parking meter street lines or markings.

B. 
The Police Department shall have lines or markings placed adjacent to each angle parking space for the purpose of designating the angle parking space, and each vehicle parked adjacent to or next to any angle parking space shall park within the lines or markings so established. It shall be unlawful to park any vehicle across any such lines or markings.

C. 
The Police Department shall have lines or markings placed adjacent to each permit parking space for the purpose of designating the permit parking space for which said permit is to be used, and each vehicle parked adjacent to or next to any permit parking space shall park within the lines or markings so established. It shall be unlawful to park any vehicle across any such lines or markings.

D. 
The Police Department shall have lines or markings placed adjacent to each reserved parking space, time limited parking space, or any other marked parking space for the purpose of designating the parking space for such use, and each vehicle parked adjacent to or next to such parking space shall park within the lines or markings so established. It shall be unlawful to park any vehicle across any such lines or markings.

Any vehicle parked in a parking space in any parking meter zone shall be parked so that the foremost part of such vehicle shall be nearest to the parking meter.

When any vehicle shall be parked, stopped or standing in any space adjacent to a parking meter which is located in accordance with the provisions of this chapter, the operator of said vehicle shall, upon entering the said parking space, immediately deposit or cause to be deposited in such parking meter the coin or coins of the United States of America required for such parking, in accordance with directions for the same  attached to said meter, and failure to deposit such coin or coins shall constitute a violation of this chapter.
It shall be unlawful and a violation of this chapter for any person to cause, allow, permit or suffer any vehicle registered in his name or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone herein described.
It shall be unlawful and a violation of this chapter to deposit or cause to be deposited in any parking meter any slug, device or metallic substitute for a coin of the United States of America.
It shall be unlawful and a violation of this chapter for any person to deface, injure, tamper with, open, willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this chapter; provided, however, that this section shall not apply to the collection of coins therefrom or to the repair and maintenance thereof.
Nothing contained in this chapter shall be construed to permit parking of vehicles in those spaces within any zone in which parking is prohibited by law, nor shall anything contained in this chapter be construed as prohibiting provision for free parking spaces for loading and unloading, bus stops, taxicab stands or for other matters of a similar or emergency nature.
The coins required to be deposited in parking meters as provided herein are levied and assessed as fees to provide for the proper regulation and control of traffic upon the public streets and the cost of supervision and regulation for the parking of vehicles in the parking meter zones hereby erected on certain of the public streets and on public parking lots, and to cover the cost of the purchase, supervision, protection, inspection, installation, operation, maintenance, control and use of the parking meters described herein.

Vehicles shall not park, stop or stand for a period exceeding the time limits established by this section between the hours of 8:00 a.m. and 7:00 p.m., prevailing time, except Sundays and holidays, in a parking space regulated by a parking meter; nor shall coins be deposited in parking meters beyond the period of legal parking time established and nor shall any vehicle be moved from parking space to parking space in an attempt to circumvent the time limits established, in the areas where parking is permitted on the below listed streets, avenues and roads, and the charge for parking a motor vehicle on said public streets, avenues and roads shall be at the following rates:
A. 
Park Avenue (Station Square to Pierrepont Avenue); Station Square; Ames Avenue; Franklin Place (Park Avenue to Chestnut Street); Orient Way (Station Square to Glen Road); Glen Road; Ridge Road (Park Avenue to East Passaic Avenue); Sylvan Street (Spring Dell to The Terrace); The Terrace (Park Avenue to Sylvan Street); Highland Cross (Park Avenue to Lincoln Avenue); West End District (Union Avenue and Santiago Avenue); West Erie Avenue, south side (Union Avenue to Agnew Place); Union Avenue (West Erie Avenue to Ayer Place); and Agnew Place (Union Avenue to West Erie Avenue).
(1) 
Fees on all meters shall be as follows: $0.25 for each 15 minutes of parking time.

(2) 
The parking of any vehicle in excess of two hours is hereby prohibited.
B. 
Orient Way (Glen Road to East Passaic Avenue); Spring Dell (Sylvan Street to Orient Way); Ettrick Terrace (Spring Dell to Orient Way).
(1) 
Fees on all meters shall be as follows: $0.25 for each 15 minutes of parking time.

(2) 
The parking of any vehicle in excess of three hours is hereby prohibited.

Fees for use of public parking lots shall be computed as follows:
A. 
Kip Avenue lot.
(1) 
Fees on all meters shall be as follows: $0.25 for each 15 minutes of parking time.
(2) 
The parking of any vehicle in excess of three hours is hereby prohibited.
B. 
Erie Avenue Park N' Ride lot. Fees on all meters shall be as follows:
(1) 
One dollar for each hour of parking time for a period of time not exceeding 12 hours.
(2) 
The parking of any vehicle in excess of 12 hours is hereby prohibited.

A. 
The schedule of charges herein established for the parking of motor vehicles on a public street in a parking space regulated by a parking meter herein designated shall be in full force and effect during the hours of 8:00 a.m. to 7:00 p.m. every day, except Sundays and holidays, except as provided in § 126-39B.[2]

The rates of charges herein established for the parking of a motor vehicle in a parking meter zone shall be designated on each parking meter in accordance with the area in which said parking meter is located.

The schedule of charges herein established for the parking of motor vehicles in the public parking lots herein designated shall be in full force and effect during the following hours:
A. 
Kip Avenue parking garage facility: between the hours of 8:00 a.m. and 7:00 p.m. every day, except Sundays and holidays.

B. 
Erie Avenue Park N' Ride lot: between the hours of 7:00 a.m. and 7:00 p.m. every day, except Sundays and holidays.

No vehicle shall be parked on the following streets, or parts of streets, except pursuant to a permit issued under this section, between the hours of 8:00 a.m. and 5:00 p.m. on Monday through Friday, with the exception of recognized legal holidays.
A. 
Location; area boundaries. The areas which this section affects shall be (and which shall not affect metered parking and payable permit parking areas):

(1) 
The first phase, which was adopted on March 9, 2015, encompasses the following areas:
(a) 
All streets east of Ridge Road to Route 17 South and Barrows Avenue to East Erie Avenue, not including the metered areas. (See map.)[2]

(2) 
The second phase, which was adopted on October 28, 2019, encompasses the following areas:
(a) 
The northern border shall be and include Washington Avenue from Carmita Avenue to West Erie Avenue. (See map.)
(b) 
The western border shall be and include Carmita Avenue from Washington Avenue to Fairview Avenue. (See map.)
(c) 
The southern border shall be and include Fairview Avenue in its entirety, and Franklin Place from Home Avenue to Park Avenue. (See map.)
(d) 
The eastern border shall be West Erie Avenue from Washington Avenue to Station Square and Park Avenue from Station Square to Franklin Place. (See map.)
B. 
Permits.
(1) 
A parking permit of a design specified by the Borough of Rutherford will be issued to the resident owner of a specific vehicle upon submission of the appropriate application and supporting documents. The permit shall display the permit number, the make, model, and color of the vehicle, and the date the permit expires. No permit shall be issued to a vehicle having more than four wheels. The vehicle must be owned by a person residing in the Borough of Rutherford.
(2) 
The following proof of residency of the vehicle's owner must be presented and approved by the Rutherford Police Department before a permit is issued:
(a) 
A copy of a valid New Jersey driver's license for the applicant which, except for leased or company-owned vehicles, reflect an address with the Borough of Rutherford;
(b) 
Except for leased vehicles [see Subsection B(2)(e) below] and company vehicles [see Subsection B(2)(f) below], a copy of a valid New Jersey motor vehicle registration for the vehicle for which the permit is sought, reflecting an address within the Borough of Rutherford;
(c) 
Proof of the vehicle being insured in the state of New Jersey;
(d) 
A current utility or telephone bill with the resident's name, and with the same address as described on the driver's license and motor vehicle registration;
(e) 
If the vehicle for which a permit is sought is leased, then a copy of the lease agreement must be exhibited;
(f) 
A resident who requests a permit for a company vehicle must provide a letter from a reasonable company official, under oath, confirming that the vehicle is assigned to that person.
(3) 
The permit is to be displayed on the front driver's side dashboard or rearview mirror when the vehicle is parked. The permit shall be removed when the vehicle is in motion.
(4) 
If a person to whom a permit is issued changes his or her resident address, but remains a resident of the Borough of Rutherford, a new permit must be obtained.
(5) 
All permits will automatically be revoked if the assigned vehicle ceases to qualify for the permit, or if a person to whom a permit has been issued ceases to be a resident of the Borough. If revoked, the permit shall be promptly returned to the Rutherford Police Department.
(6) 
The following shall apply to employees of businesses located within the permit-only parking zone (see Subsection A above):

(a) 
Employees of businesses located within the permit-only parking zone (see Subsection A above) shall be entitled to one permit.
(b) 
Employees of businesses located within the permit-only parking zone (see Subsection A above) shall submit proof of employment with business covered under this section prior to a permit being issued.
(c) 
Subsections B.(2)(a), (b), and (d) shall not apply to employees of businesses located within the permit-only parking zones (see Subsection A above) requesting permits.
C. 
Visitor's permits.
(1) 
Two visitor permits per household may be issued for use by visitors to residents on the streets, or parts of streets, listed in Schedule A Map[3] only while visitors are actually visiting the household to which they were issued. There shall be a rebuttable presumption that any vehicle parked more than one block from the household for which the visitor permit has been issued is not visiting such household.

(2) 
The visitor permit is to be displayed on the front driver's side dashboard above the steering wheel, and must be fully readable from the exterior of the vehicle.
(3) 
The visitor permit shall be returned to the resident at the conclusion of the visit.
(4) 
The visitor permit shall be valid for one year from the date of issue. The expired visitor permit must be returned to the police department before a new one can be issued.
(5) 
No visitor permit shall be issued to any person residing in any building exclusively used by students and affiliates of a college.
D. 
New permits required for changes in residency or vehicles.
(1) 
A new permit must be obtained in the event of change of residency or change of any vehicle or license plate on a previously registered automobile.
E. 
Revocation of permits.
(1) 
Parking permits will automatically be revoked if a vehicle ceases to qualify, if affixed to a car other than the one so designated at the time of application, or if the vehicle registration number on the parking permit is different than the one on the vehicle.
(2) 
Any vehicle bearing a revoked parking permit and parked on a street posted "permit only" will be subject to the same penalty as a vehicle parked in that location without a valid permit.
F. 
Expiration of permits.
(1) 
Permits will be valid for two years from the date of issue. Visitor permits shall be valid for one year from the date of issue.
(2) 
Any vehicle bearing an expired visitor permit and parked on a street posted "permit only" will be subject to the same penalty as a vehicle parked in that location without a valid permit.
G. 
Violations and penalties.
(1) 
Any vehicle parked in violation of the parking permit regulations will be subject to a fine of $50.
(2) 
Residents in possession of parking permits who misuse them are subject to revocation of the permits for one year and a fine of $100.
(3) 
Any person(s) found to possess a valid, expired, temporary, visitor, or business permit, not belonging to that person, or a counterfeit permit shall be subject to a fine of $100.

(4) 
Vehicles shall be granted a three-hour grace period, after which time they will be ticketed.
H. 
Zone designated.
(1) 
The phrase "parking permit zone" shall mean such street or area upon which parking is permitted only for vehicles displaying a valid permit.
I. 
To the extent the streets covered by this ordinance are covered by other section establishing restrictions, those ordinances are hereby amended to exclude these streets from those restrictions between the hours of 8:00 a.m. and 5:00 p.m. on Monday through Friday, with the exception of alternate-side-of-the-street parking, snow-emergency parking, and designated legal holidays.

If any provision of this article shall be held to be unconstitutional, the remaining provisions shall remain in full force and effect.
