The City Council of the City of Somers Point
hereafter "City") hereby reestablishes the committee which shall hereafter
be known as the "Somers Point Arts Commission" (hereafter "Arts Commission").
The existence of the Arts Commission shall be
perpetual, subject only to City Council's right and power to rescind
or amend its existence and terms of existence.
The mission of the Arts Commission shall be
to provide, promote and cultivate the Arts in Somers Point through
support and coordination of community resources.
The Arts Commission shall have such additional
primary and lesser functions, purposes and goals as the Arts Commission
may from time to time submit to City Council, subject to City Council's
selection and approval, and/or as may from time to time be determined
by City Council by way of amendment to this chapter or by resolution.
In regard to its mission and such primary and
lesser functions, purposes and goals as it may be authorized, the
Arts Commission shall:
A.
Discuss, investigate, study and give written advice
and recommendations to City Council as determined by the Arts Commission,
and/or as may be requested by City Council, on matters as fall within
the Arts Commission's mission and its other authorized primary and
lesser functions, purpose and goals;
B.
Market and promote the City's cultural and performing
arts as may be authorized by City Council;
C.
Recommend, in writing, to City Council the manner
in which and the means by which the Arts Commission can best achieve
its mission and such primary and lesser functions, purposes and goals
as it may be authorized.

A.
The Arts Commission shall consist of nine regular members appointed by City Council who shall meet the qualifications set forth in § 2-7 and shall have the voting privileges as provided in § 2-8; and all members shall have a term of office of one calendar year or such lesser period of time as may be caused by the date of appointment, with all terms expiring at 11:59 p.m. on December 31 of each calendar year or until the Reorganization Meeting of City Council in the subsequent calendar year.
B.
The
Arts Commission may recommend to City Council the appointment of up
to four ex officio nonvoting members who need not be residents or
taxpayers to serve in an advisory capacity and who have a particular
ability, skill, or interest in the arts and whose term shall expire
at 11:59 p.m. on December 31 of each calendar year and whose appointments
shall be subject to approval by City Council.

The regular members of the Arts Commission shall be residents
or taxpayers of the City, or his/her designee, subject to approval
by City Council.

All regular members of the Arts Commission shall have full voting
privileges.
The appointment of members of the Arts Commission
shall be made by City Council by resolution as soon as practicable
after the establishment of the Arts Commission by this chapter, in
this calendar year of its establishment, and in succeeding years at
the Annual City Council Reorganization Meeting, or any subsequent
regular meeting of City Council in January of each calendar year.
No appointment of any member of the Arts Commission
in any calendar year may be rescinded or terminated by City Council
except for good cause.
Any vacancy created by any resignation of any
member of the Arts Commission during any calendar year may be filled
by appointment by City Council by resolution for the remainder of
that member's term of office.
The members of the Arts Commission shall meet
within 30 days of their appointment.
At the first meeting in each calendar year the
Arts Commission shall:
A.
Elect a chairperson, vice-chairperson and a secretary;
B.
Establish a schedule of meeting dates for the remainder
of the calendar year;
C.
Establish a list of primary and lesser goals and a
mission statement for the calendar year;
D.
Establish a schedule of performance due dates for
reports of any investigation or study to be undertaken by the Arts
Commission during the calendar year.
All meetings shall have accurate and sufficient
written minutes which shall be promptly prepared, approved and forwarded
to City Council. A member shall be elected by the Arts Commission
each calendar year to perform the duties of minute-taking and preparation
and such other clerical tasks as may be necessary or desired, and
that member shall be the Secretary.
The product and minutes of the first meeting
of the Arts Commission in each calendar year shall promptly be forwarded
to City Council, and all products and minutes of every meeting thereafter
shall be promptly prepared and approved by the Arts Commission and
then forwarded to City Council.

The Arts Commission may organize its activities, investigations,
studies and reports by committee, but no committee action or recommendation
shall have status as an action or report by the Arts Commission unless
adopted by a majority vote of those Arts Commission regular members
present at which there is a meeting quorum, and on reasonable advance
notice to the voting membership of the Arts Commission.
Any and all investigations, studies, calls for action, reports or recommendations for action adopted by a majority vote of the Arts Commission shall be promptly forwarded to City Council and they shall not be published or disseminated in any way whatsoever until that is accomplished and until and unless reviewed, accepted and approved by City Council by resolution. Any Arts Commission member violating this section, or § 2-18 or 2-19, may have his/her appointment rescinded and terminated for cause by City Council.
No implementation of any call for action or
any report and recommendation by the Arts Commission to City Council
shall take place or have any status as action by the City or a report
of the City or a policy of the City, unless and until accepted and
approved by City Council by resolution, and City Council in its discretion
may decline to act, accept or approve, or may act upon, accept or
approve, any portion or the whole, as it desires and determines.
The Arts Commission, being an Advisory Commission
of City Council and being subordinate to City Council and subject
to the oversight of City Council, shall conduct its activities and
meetings in accord with all applicable state law, which shall include,
but may not be limited to, the Open Public Meetings Act and the Open
Public Records Act.[1]

The Arts Commission's meetings and deliberations
shall proceed in accord with the latest version of Robert's Rules
of Order.
Resolution 145-2004 is hereby rescinded and
abolished, and any appointment of members to the old committee established
thereby, and the terms of office of said members, are likewise rescinded
and abolished. Nothing herein shall prevent or preclude the members
or any member of the old committee from being appointed as a member
or members of the new Arts Commission, as City Council shall determine
in its discretion.
