There is hereby created the office of Construction Official and Code Enforcement Officer whose powers, duties and functions shall be as follows:
He shall be charged with the administration of all building codes adopted by the City of Somers Point and of any and all state or federal building codes or regulations where the enforcing officer is designated as the Construction Official.
He shall perform all the duties and functions of a Construction Official as set forth in all ordinances.
The Construction Official or a representative in his absence, shall inspect buildings, plans or premises for compliance with building codes and order, in writing, the correction of any condition found to exist which is in violation of these provisions.
He shall issue building and construction permits and shall retain no part of said fee. All fees shall be payable to the City of Somers Point.
He shall issue certificates of occupancy as set forth in Chapter 100, Construction Codes, Uniform.

He shall make monthly reports to the Tax Assessor and City Clerk of all certificates issued and of building permits issued.
He shall issue all builders' licenses upon receipt of a building contractor's license application. All license fees due and payable for a builder's license shall be payable to the City of Somers Point, no part of which fee shall be retained by the Construction Official.
He shall investigate the condition of vacant parcels of land, land and buildings and dwelling houses within the City of Somers Point as to their condition of health and safety and whether they are unfit for human habitation.

The Police Chief or Deputy Police Chief shall have the further duty of enforcing the following laws and/or departments:
He shall be responsible for enforcing any and all other ordinances of the City where said ordinances do not specifically designate who the enforcing officer shall be.
The Somers Point Sewer Utility through the Superintendent of Public Works or his/her designee shall have the authority to regularly inspect all grease, oil and sand interceptors. The results of the inspections shall be furnished to the Construction Official and Plumbing Subcode Official for code enforcement.

All grease, oil and sand interceptors shall be maintained by the owner at his expense in continuous efficient operation at all times.
It is the responsibility of the establishment owner, lessee or assignee to carry out all of the proceedings necessary to have any and all grease trap interceptors opened and ready for inspection and to see that the equipment is put back in proper operation after the inspection.
Forms for the periodic inspections will be furnished by the owner, lessee or assignee and posted as close as possible to the interceptor to which it applies. The form shall also be protected from soiling.
The offices of Construction Official and Code Enforcement Officer are hereby created as one office, the appointment for which shall be made by a majority vote of the Council.
It shall be unlawful for any person holding said office to act as an employee of a builder or as a builder contractor within the City of Somers Point.
