A.
Responsibility of the establishment.
(1)
No establishment possessing a retail consumption license for alcoholic beverages in the City of Somers Point, New Jersey, shall allow or permit the playing of any musical instrument, device or sound recording between the hours of 2:30 a.m. and 7:00 a.m. on weekdays and Saturdays or between the hours of 2:30 a.m. and 12:00 noon on Sundays.
(2)
No establishment possessing a retail consumption license for alcoholic beverages in the City of Somers Point, New Jersey, shall allow or permit the playing of any musical instrument, device or sound recording on any outside deck or other exterior space of the premises between the hours of 11:00 p.m. and 12:00 noon.
B.
Responsibility of others.
(1)
No person and/or persons shall play or permit to be played any musical instrument, device or sound recording between the hours of 2:30 a.m. and 7:30 a.m. on weekdays and Saturdays or between the hours of 2:30 a.m. and 12:00 noon on Sundays in any establishment possessing a retail consumption license for alcoholic beverages in the City of Somers Point, New Jersey.

(2)
No person and/or persons shall play or permit to be played any musical instrument, device or sound recording between the hours of 11:00 p.m. and 12:00 noon on any outside deck or other exterior space of the premises of any establishment possessing a retail consumption license for alcoholic beverages in the City of Somers Point, New Jersey.
C.
On New Year's Day, musical instruments, devices or sound recordings may be played up to 4:30 a.m., but not on any outside deck or other exterior space of the premises of any establishment possessing a retail consumption license for alcoholic beverages in the City of Somers Point, New Jersey.
