For the purposes of fulfilling the City of Somers
Point affordable housing obligation as prescribed by the New Jersey
Council on Affordable Housing N.J.A.C. 5:91-1 et seq. and N.J.A.C.
5:93-1 et seq., and the New Jersey Fair Housing Act, N.J.S.A. 52:27D-301,
et seq., the City sets forth the following standards for the purpose
of developing an inclusionary affordable housing development project
as follows.
A.
Permitted uses. Multifamily residential and townhomes
shall be permitted principal uses in accordance with the design and
area standards outlined below.
B.
Accessory uses. Any accessory use and building reasonably
and customarily incidental to any of the principal uses permitted,
provided that they do not create conditions detrimental to the health,
safety or general welfare of the community.

Parking lots and parking structures shall be
permitted as an accessory us.
A.
General design requirements. All residential buildings
shall be designed with a minimum of three separate facade materials
and various projections such as porches, decks, dormers, porticos
and the like. There shall also be breaks along the facades to add
visual interest. The overall architectural concept shall be generally
consistent with the predominant vernacular in the community.

(1)
Maximum units: 120 units (94 market rate plus
26 low- and moderate-income). Twenty-six low- and moderate-income
rentals shall be provided in accordance with the New Jersey Council
on Affordable Housing's rules and regulations and consistent with
Section 3.4.1 of the Settlement Agreement of Litigation in the matter
of Bay Avenue Redevelopers, L.L.C., Bass Harbor, L.L.C., Harbour Cove
Marina, L.L.C., and S.P. #2v. City of Somers Point, Docket No. ATL-L-3204-05
P.W. (Mount Laurel) (the "Settlement Agreement"), shall be located
on a subdivided lot that shall contain no market rate housing units.

Minimum tract acreage: 2.5 acres.
(3)
Minimum lot size: two acres, except for buildings
of 100% affordable units.
(4)
Maximum density: 50 D.U. per acre.

Maximum height: 48 feet.

Off-street parking shall be provided in accordance
with Residential Site Improvement Standards (RSIS).
(8)
All off-street parking shall be set back a minimum
of 10 feet from rights-of-way, except along the Pleasant Avenue right-of-way,
where zero feet shall be permitted.
(9)
Minimum distance between structures shall be
in accordance with Building and Code Officials Association (BOCA)
standards.
(10)
Portions of the site may be used for boat storage
and parking.
C.
AH2.
(1)
Maximum units: 16 units.
(2)
Minimum lot acre: 0.75 (±) acres.
(3)
Maximum density: 22 D.U. per acre.
(4)
Maximum height: 48 feet.
(6)
Off-street parking shall be provided in accordance
with Residential Site Improvement Standards (RSIS).
(7)
All off-street parking shall be set back a minimum
of 10 feet from right-of-way except along the Pleasant Avenue right-of-way,
where zero feet shall be permitted.
(8)
Minimum distance between structures shall be
in accordance with Building and Code Officials Association (BOCA)
standards.
(9)
Portions of the site may be used for amenities
in addition to residential uses.
D.
AH3.
(1)
Maximum units: 190 units.
(2)
Minimum acreage: 8.20 (±) acres.
(3)
Maximum density: 23 D.U. per acre.
(4)
Maximum height: 48 feet.
(6)
Off-street parking shall be provided in accordance
with Residential Site Improvement Standards (RSIS).
