The purpose of this article is to establish
certain areas that are private or quasi-public and that are open to
the public or to which the public is invited where parking shall be
prohibited in areas designated as handicapped parking spaces for use
by persons who have been issued special identification cards by the
Division of Motor Vehicles. No other person or persons shall be permitted
to park in these spaces.
This article is enacted in accordance with N.J.S.A.
40:48-2.46, which confers upon the City of Somers Point the right
to establish handicapped parking spaces in order to preserve and safeguard
the public health, safety, morals and welfare.
The following areas shall be designated as handicapped
parking spaces and shall be so marked by signs indicating handicapped
parking spaces, in conformance with the manual on uniform traffic
control devices for streets and highways:

Unless another penalty is expressly provided
by New Jersey statute, every person convicted of a violation of a
provision of this article or any supplement thereto shall be liable
to a penalty of not more than $51 or imprisonment for a term not exceeding
15 days, or both.
All ordinances or parts of ordinances inconsistent
herewith are hereby repealed, and this article shall take effect immediately
upon final passage and publication as required by law.
