[HISTORY: Adopted by the Township Council of the Township of Stafford 5-18-1993 as Ord. No. 93-33. Amendments noted where applicable.]
The short title of this chapter shall be the "Buses Ordinance," and this chapter shall be hereinafter cited and referred to for the purpose of amendment or otherwise by said title.
The Township of Stafford defines and declares that the purpose of this chapter is to protect the people and property of this Township and to preserve the safety and welfare of the Township and its citizens by regulating and promoting safe bus pickup and discharge from private property.
As used in this chapter, the following terms shall have the meanings indicated:
BUS
Any motor vehicle operated over public highways or public places in this state for the transportation of passengers for hire in intrastate business, notwithstanding that such motor vehicle may be used in interstate commerce. Nothing contained herein shall be construed to include any bus activity regulated by state statute, as well as any bus activity operated by a governmental entity or any nonprofit organization.
Pickup and discharge of passengers from a bus is strictly prohibited from all private property within the Township, unless the owner or his agent of the private property has granted prior written permission and filed the same with the Township Zoning Office and/or the Township Police Department.
The prohibition of § 77-4 above shall be unenforceable unless a sign which clearly indicates that bus pickup and discharge is prohibited on all private property within the Township and the penalty for violation of this chapter has been prominently posted by the owner of the private property.
The sign required by § 77-5 above shall comply with the provisions of § 211-35P of this Code, except that the sign shall be permitted as an exception from the approval required by § 211-35P(3)(a).
A.
All persons violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not less than $100 and not more than $1,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B.
The violation of any provision of this chapter shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
